Judge refuses to gag Trump in classified docs case after ‘basic’ special counsel error

Former President Trump’s attorneys on Monday accused the government of “unconstitutional censorship” in response to federal prosecutors asking the judge in his classified documents case for a gag order.

In a court filing, Trump’s outraged legal team asked a federal judge in Florida to sanction and fine prosecutors from special counsel Jack Smith’s office, which requested that the court modify Trump’s conditions of release and prohibit him from making future statements about FBI agents who executed a search warrant at Mar-a-Lago on Aug. 22, 2023. 

“President Donald J. Trump respectfully submits this procedural opposition to the May 24, 2024 filing by the Special Counsel’s Office, which improperly asks the Court to impose an unconstitutional gag order on President Trump, as a condition of his pretrial release, based on vague and unsupported assertions about threats to law enforcement personnel whose names have been redacted from public filings and whose identities are already subject to a protective order,” Trump’s lawyers wrote in the filing.

“… [T]he Court should strike the Motion, make civil contempt findings as to all government attorneys who participated in the decision to file the Motion without meaningful conferral, and impose sanctions after holding an evidentiary hearing regarding the purpose and intent behind the Office’s decision to willfully disregard required procedures,” the defense attorneys wrote.

JACK SMITH ASKS JUDGE TO RESTRICT TRUMP STATEMENTS AFTER ‘INFLAMMATORY’ REMARKS ABOUT FBI RAID

On Friday evening, Smith’s team filed a motion to U.S. District Judge Aileen M. Cannon, who is presiding over the classified documents case, and requested that she prohibit Trump from making statements that “pose a significant, imminent, and foreseeable danger to law enforcement agents participating in the investigation and prosecution of this case.” Trump claimed in a campaign appeal that FBI agents were “locked & loaded ready to take me out & put my family in danger.”

Prosecutors said Trump’s “grossly misleading” claims cited a standard FBI form that details limiting the use of force to emergency situations. The same form was used when federal agents searched for documents at President Biden’s home.

“Trump, however, has distorted the standard inclusion of the policy limiting the use of deadly force by mischaracterizing it as a claim that the FBI “WAS AUTHORIZED TO SHOOT ME,” was “just itching to do the unthinkable,” and was “locked & loaded ready to take me out,'” Smith’s team wrote in their filing.

The prosecution argued that Trump’s “deceptive and inflammatory claims” exposed federal agents to “unjustified and unacceptable risks,” inviting “threats and harassment” against investigators that would “undermine the integrity of the proceedings as well as jeopardize the safety of law enforcement.”

Trump’s attorneys countered Tuesday that Smith’s request was “an extraordinary, unprecedented and unconstitutional censorship application” that “unjustly targets President Trump’s campaign speech while he is the leading candidate for the presidency.” 

They requested that Judge Cannon hold a hearing to determine Smith’s “motives and purpose” in filing the gag order motion “on the Friday preceding a holiday weekend,” pointing out that Trump’s defense summation is scheduled to begin in Manhattan on Tuesday for his New York criminal case. The timing, they insisted, violated rules governing how motions are filed and was unprofessional. 

The 15-page motion also referred to Smith and his team as “the Thought Police” and accused prosecutors of being “biased and reckless” and “driven by political animus against President Trump.”

Trump has repeatedly claimed the indictment Smith filed against him last June was part of a politically-motivated “witch hunt” designed to keep him from winning the presidency. Smith’s team has vehemently denied the allegations and asserted their motives are pure, intended to support the rule of law.

Trump is accused of keeping at his estate classified documents that he took with him after he left the White House in 2021, and then obstructing the government’s efforts to retrieve them. The FBI agents seized 33 boxes of documents in the raid.

The investigation is overseen by Smith, who Attorney General Merrick Garland appointed. Smith has charged Trump with 40 felony counts, including violating the Espionage Act, making false statements to investigators and conspiracy to obstruct justice.

Trump has pleaded not guilty. The case is not expected to go to trial until after the November election.

Donald Trump makes dramatic statements ahead of closing arguments in NYC trial

Former President Trump said Tuesday it is a “very dangerous day for America” ahead of closing arguments in the NY v. Trump case. 

“This is a very dangerous day for America. It’s a very sad day,” Trump said in remarks to the media before heading into the Manhattan courtroom Tuesday morning

“Make no mistake about it, I’m here because of crooked Joe Biden. The worst president in the history of our country, he’s destroying our country. This country is being destroyed rapidly, not slowly, rapidly. On the borders, on energy, on inflation, on everything you can name, Afghanistan removal. Everything about what he’s done, he’s destroying our country, and he’s also destroying it with weaponization. And this is purely is weaponization,” Trump added in his remarks. 

Trump, who has been flanked by a handful of allies in recent days during court proceedings, was joined by his children Tiffany, Eric, and Don Jr. on Tuesday. Trump has repeatedly slammed the trial as a “sham” promoted by the Biden administration to politically injure him ahead of the 2024 election.

Trump is facing the end of the trial in Manhattan, where he faces 34 counts of falsifying business records. Prosecutors are working to prove that Trump falsified business records to conceal a $130,000 payment to former pornographic star Stormy Daniels ahead of the 2016 election to quiet her claims of an alleged affair with Trump in 2006. 

Trump has pleaded not guilty and has repeatedly denied any affair with Daniels.

Presiding Judge Juan Merchan said last week he anticipates closing arguments to last all of Tuesday and perhaps part of Wednesday. Merchan, this week, will also deliver his instructions to the jury, which he anticipates will last roughly an hour. 

Trump has been required to sit in the courtroom throughout the trial and is also required in the courtroom during deliberations in the event of any jury notes. 

Closing arguments follow Trump’s defense team motioning for dismissal of the case following the prosecution team’s star witness, former Trump attorney Michael Cohen. 

Trump attorney Todd Blanche said last week there were “absolutely no false business filings” and no evidence of connection to Trump.

“How on Earth is keeping a false story from voters criminal?” Blanche said.

“There is no way the court should let this case go to the jury with Mr. Cohen’s testimony,” he added.

Cohen testified before the court he personally paid Daniels $130,000 by taking out a home equity line of credit, which he said he concealed from his wife. Cohen also admitted in testimony that he stole thousands of dollars from the Trump Organization.

Cohen said that he stole $30,000 from the Trump Organization by overstating how much he paid a tech company that provided services for the company. Cohen said he told former Trump Organization CFO Allen Weisselberg in 2017 that he had paid tech firm Red Finch $50,000 out of his own pocket, and that he still needed to be reimbursed for the payment. 

Weisselberg and Cohen in 2017 calculated a $420,000 repayment to Cohen for his $130,000 payment to Daniels, as well as the alleged $50,000 payment to Red Finch. 

“You stole from the Trump Org, right?”  Blanche asked Cohen last Wednesday morning. 

“Yes, sir,” Cohen responded.

On Tuesday morning, Trump also said his team had an election expert who was set to testify last week and show that “everything was perfect” referring to former FEC Commissioner Bradley Smith.

Manhattan District Attorney Alvin Bragg’s office is working to prove to the jury that not only did Trump falsify the business records related to payments to Daniels, but that he did so in furtherance of another crime: conspiracy to promote or prevent election.

The election expert did not testify after Merchan ruled that Smith could speak before the court on the basic definitions surrounding election law but not expand beyond that scope. 

“And we had a lot of other people. I can give you a list of 40 people that would say the exact same thing as these people said,” Trump said Tuesday before continuing, it is a “dangerous day for America.” 

Crime scene analyst finds two ‘beings’ with ‘cloaking device’ in Las Vegas backyard

There are at least two “beings” using some sort of “cloaking device” that landed in a Las Vegas backyard, a veteran crime scene reconstruction analyst said. 

Scott Roder, who has testified as an expert in some of the most highly publicized criminal cases in the world, broke down a video of a reported alien sighting in Las Vegas frame by frame. 

In one second of real time, there are 30 frames that show a “head… with smoke around it,” which Roder called “some sort of cloaking device,” moving into the top right corner of the video and peering over the fence. 

“I applied the same principles that I would apply to any kind of homicide investigation,” said Roder, who testified in cases like Oscar Pistorious’ murder trial. “At this particular time, with what we’ve seen here, is proof of a couple of things. That these entities… are real. They’re there. This is not fake. This is not a fraud.”

Roder worked with Jim Quirk – a reporter who runs the Extraterrestrial Reality podcast and who shared videos and images with Fox New Digital – to recreate the scene in the Las Vegas backyard on April 30, 2023. 

Before the reported alien sighting, there was an unexplainable streak of light that raced across the sky. It was captured on Las Vegas police bodycams. 

And at least 21 people across eastern California, Arizona, Nevada and Utah reported seeing the glowing green light, according to the American Meteor Society.

ALIENS ‘HAVE BEEN ON EARTH A LONG TIME’: STANFORD PROFESSOR

Shortly thereafter, Angel Kenmore called 911 and told the dispatcher that he saw a “tall, skinny alien creature with greenish color,” about 8 to 10 feet tall, hiding behind their forklift in the backyard. 

In a video Kenmore shared on YouTube, Kenmore and three other family members walk in a line and react to something and run. What they likely didn’t even realize, is a potential second being peering over a tall fence, Roder said. 

Kenmore plays a short clip in his YouTube video of when he and his family saw the “creature.” He said, “You can’t see it too good, but it’s there,” he said. 

The camera catches only a glimpse of the backyard, but it’s difficult to spot anything with the naked eye.

Not only does Roder point out what he believes is the “creature” Kenmore describes, but there’s a second “visual anomaly” that moves into the right-hand corner of the video, above the fence. 

“You can’t manifest something to move inside the screen,” he said during Quirk’s podcast, which first showed Roder’s work and theory. “I think that’s why I like this video is because you can clearly show something in the background that at least Angel and the uncle or his dad are reacting to. 

“And it makes sense to me that that’s what they’re reacting to. And whatever it is, it’s moving.”

This event, which started with the streaking light in the sky and included responding officers’ bodycams showing the Kenmore family’s reaction and description of what they saw, has been a source of debate for over a year.

Debunkers have said it’s a shadow or a smudge, and wrote the potential alien sighting off as either a hoax or overreaction to a shadow.

That’s not what Roder or Quirk believe after spending hours breaking down the video frame by frame. 

“You have to look at the totality of the evidence,” said Roder, referring to the light in the sky that didn’t make a sound, the police response and bodycam, and how the “visual anomalies” move.

Roder said there are people who don’t agree with his analysis, so he opened it up to “peer review.” 

“Bring it on,” he said. “I want to open this up. Everything that we’ve done. I’m opening it up for peer review… I’m willing to hear what professionals in my field have to say about this and open it up. And if I’m wrong, you know, I’ll admit it.”

But he’s certain he’s right. 

These two items, these two beings, are in the real world environment with the Kenmore family. That’s a fact,” Roder said. “Now the question is. Who are they? Where are they from and what do they want? That’s where the conversation goes.”

In an interview with Fox News Digital, Roder and Quirk said, “This is only the beginning of their investigation.”

They believe they found more evidence that was previously missed. 

Sailors’ worst nightmare as 80-foot yacht sinks after hitting pipe off Florida coast

Two boaters were rescued from a sinking 80-foot yacht over the weekend after the vessel struck a submerged dredge pipe off the coast of Florida, authorities said.

The operator of the motor yacht Atlantis sent a distress call around 11:30 a.m. Saturday stating the vessel struck an object and began taking on water about three miles off St. Augustine Beach, the U.S. Coast Guard (USCG) said.

Marine units with St. Johns County Fire Rescue rescued two people aboard the sinking yacht. One of the individuals suffered minor injuries and was taken to a local hospital in stable condition, the USCG said.

Photos show the stern of the yacht sinking beneath the water and tipping the bow straight toward the sky.

The vessel is believed to have struck a dredge pipe piling that was partially submerged, according to St. Johns County Fire Rescue.

The Coast Guard thanked St. Johns County Fire Rescue, local police and nearby good Samaritans for helping to coordinate the rescue of the stranded mariners from the sinking yacht.

Officials also noted that the luxury yacht activated its properly registered emergency position indicating radio beacon (EPIRB) to allow rescuers to pinpoint the vessel’s location.

“With the weather improving and mariners heading out onto the water, it’s imperative for everyone to verify the presence of all necessary safety equipment aboard their vessel,” said Senior Chief Petty Officer Ricardo Santacana, the command duty officer of Sector Jacksonville. “This ensures that responders, as demonstrated in this case, can swiftly locate you and render assistance when an emergency arises.” 

The owner of the Atlantis is expected to arrange salvage, according to USCG officials.

Dem strategists worry horror show election scenario playing out for Biden

A number of Democratic Party strategists are predicting defeat in the heated race against former President Trump, according to a new report. 

“You don’t want to be that guy who is on the record saying we’re doomed, or the campaign’s bad or Biden’s making mistakes,” a Democratic operative speaking anonymously told Politico. “Nobody wants to be that guy.” 

“This isn’t, ‘Oh my God, Mitt Romney might become president.’ It’s ‘Oh my God, the democracy might end,'” they said, adding that Biden’s low polling numbers have contributed to a “freakout” among Biden supporters. 

A recent Bloomberg News/Morning Consult poll found Trump leading Biden in seven key swing states — Arizona, Georgia, Michigan, Nevada, North Carolina, Pennsylvania and Wisconsin. Biden won every one of those states but North Carolina in 2020 and they were decisive to his victory.

A Biden adviser revealed to Politico that donors are also concerned about the incumbent president’s campaign against Trump. 

The adviser said that it’s “much easier to show” donors the weaknesses of Biden’s campaign “so while they read it, I can pour a drink.”

“The list of why we ‘could’ win is so small I don’t even need to keep the list on my phone,” the adviser said. 

But not all Biden supporters are speaking anonymously about their concerns over the 2024 presidential campaign. Outspoken strategist James Carville has been critical of the party’s messaging and approach in this election year.

Another Democratic strategist spoke openly about the greatest obstacle that the Biden campaign has to overcome in order to achieve victory in November.

“There’s still a path to win this, but they don’t look like a campaign that’s embarking on that path right now,” political strategist Pete Giangreco said. “If the frame of this race is, ‘What was better, the 3.5 years under Biden or four years under Trump,’ we lose that every day of the week and twice on Sunday.”

Even in blue strongholds like New York City, Trump’s aggressive campaigning in the South Bronx has Democrats worried. 

“New York Democrats need to wake up,” Manhattan Borough President Mark Levine told the outlet. “The number of people in New York, including people of color that I come across who are saying positive things about Trump, is alarming.”

Earlier this month, former Obama advisor and CNN political analyst David Axelrod warned that Biden was making a “terrible mistake” by defiantly defending the state of the economy, saying, “If he doesn’t win this race, it may not be Donald Trump that beats him. It may be his own pride.”

Veteran Democratic strategist Paul Begala worried in March that third party candidates like Robert F. Kennedy, Jr. and Cornel West could “foul it up” for Biden and throw “the whole election to Donald Trump.”

Democrats believe they have a magical cure to Chicago’s crime crisis — but it’s not that simple

Once again, our Illinois politicians believe they have the magic that will cure the crime that riddles our city of Chicago. I recently learned that our state’s Democratic lawmakers plan to introduce House Bill 4409 to amend the Illinois Crime Reduction Act of 2009 in order to rename “offenders” as “justice-impacted individuals.” That is right — with the magic of rewording, we will no longer have “offenders” or “criminals.” Instead, we will have “justice-impacted individuals” and the implication could not be clearer: rather than being seen as criminals who victimized society they will be seen as victims of the system.

I wish it were that simple. 

If it were, I could stop my work as a pastor who has tried to reform criminals in the Woodlawn neighborhood on the South Side for the last 20 years. I could stop construction on my massive Project H.O.O.D. community center designed to take back the neighborhood from criminals. But you and I know that this latest move by our state politicians is just more leftist foolishness.

ILLINOIS POLITICIANS AIM TO CHANGE WORD ‘OFFENDER’ TO ‘JUSTICE-IMPACTED INDIVIDUAL’

It makes me tired. I’m of watching how these liberals have sprinkled this magic dust in my neighborhood over and over — for the last seven decades. In the beginning, long before I arrived on the South Side to begin my ministry, they introduced welfare policies that took the father out of the home in exchange for government dependency. 

Year after year, they failed to provide us with sufficient schools and teachers — today, the nearby elementary school produces kids who can barely read or do math. And only several months ago, less than a year ago, Chicago Mayor Brandon Johnson announced that he would magically achieve equity by shuttering some of the city’s best public high schools because it wouldn’t be fair to the Black kids in poor performing schools.

I wish I could laugh at this foolishness, but I can’t. I’m so tired of politicians claiming to care about us and then running away from the failures that their policies have caused. Instead, they prefer to sprinkle the magic dust of empty words, hoping to distract us. Sadly, it works too often.

Every single offender that I have encountered on the streets or in my church broke the law. They knew what the law was, and they crossed the line anyway. They hurt people, even killed people. You can’t erase these consequences with a turn of a phrase.

But what bothers me profoundly about the left is their consistent refusal to see people in my neighborhood as fully human. That is why calling criminals in my neighborhood “justice-impacted individuals” is just more of not seeing them as fully human.

By contrast, I see these fallen men and women for who they are: criminals. We have to focus on the reality of that. It may not be fair that many of them were born into great poverty and burdened with disadvantages, but that is no excuse to embark on the criminal path.

Every single offender that I have encountered on the streets or in my church broke the law. They knew what the law was, and they crossed the line anyway. They hurt people, even killed people. You can’t erase these consequences with a turn of a phrase.

But what I believe in my heart is that you can reform a criminal into a law-abiding citizen. The first step begins with finding the individual hiding under that criminal armor. When you do that, you reconnect that individual to all the good things in life, especially to who they are as a person. 

Then you begin to show that individual the possible new pathways in life. I tell them over and over that it is possible for them to change their lives for the better — to become good employees, to become good parents, and to become good citizens.

Jake Paul makes fiery accusation about Mike Tyson after in-flight health scare

Mike Tyson had a brief medical scare on a flight on Sunday, but do not tell that to his next opponent.

The boxing legend’s representatives told the New York Post that the 57-year-old became nauseous and dizzy on a flight from Miami to Los Angeles.

However, Jake Paul says “nothing changed” as far as their heavily anticipated fight this summer.

The reported incident came less than two months before Tyson and Paul are set to face one another in Dallas for what is slated to be the most-watched boxing match maybe ever, and for at least one generation, it is certainly the most anticipated.

However, Paul is calling B.S.

“You love to make s— up before knowing the facts for clicks / likes. Nothing changed,” the 27-year-old wrote on X.

In Touch Weekly was first to report Tyson’s scare, which they categorized as a “medical emergency.”

“Mike had some kind of medical emergency on the plane and paramedics boarded,” a source told In Touch Weekly. “Before the paramedics arrived, the flight issued an announcement asking for a doctor – the message even came on everyone’s screens.”

The medical scare reportedly delayed passengers from leaving the plane for 25 minutes. 

“He was in first class, but we were in an exit row and the stewardess was very chatty,” a source told In Touch Weekly. “They asked us to stay on the plane and landed, so paramedics could enter. She said something like, ‘He’s a really important passenger so we wanna make sure he’s OK.’ I knew it was him, but I just mouthed the words ‘Mike Tyson,’ and she nodded her head yes.”

Tyson and Paul held their press tour in both Harlem, New York, and Dallas earlier this month in two separate press conferences. The first one was full of laughter and jokes, but the second was much more serious, with the two both making bold predictions about potential knockouts in the bout.

There are some who have questioned whether Tyson can physically get back in the ring again. He will turn 58 years old next month (June 30), and he openly said his body feels like “s— right now” with soreness, during the New York presser.

That was the humble Tyson, but he was talking the talk a few days later, ripping Paul.

“He’s going to knock me out? Anderson Silva. He couldn’t even knock out the little guys, how’s he going to knock me out?” Tyson said, while previously bringing up Paul’s fight with Nate Diaz as well.

Moms vow to ‘get rid of Bidenomics forever’ as they struggle to make ends meet

The kitchen table economics of American households have become a battleground for frustrated moms who find themselves struggling with the realities of the Biden administration’s policies.

“It is bad. The mom-and-pop stores are closing down at an alarming rate. [It takes] two to three jobs per person just to make ends meet,” Kristina Tullos, a concerned mom from Hawaii, said Tuesday on “Fox & Friends First.”

Tullos was one of three moms who spoke with co-host Carley Shimkus about their financial frustrations under the current administration.

HIGH INFLATION IS HITTING PARENTS THE HARDEST

Quisha King, a business owner, podcast host and single parent, compared her life under the Trump administration to the one she currently lives, zeroing in on the struggle to cover the cost of everyday necessities.

“It’s so debilitating,” she said. “I am so ready to vote for a change, [to] vote for Donald Trump to get rid of Bidenomics forever.

“You get scared to even pull up your bank account because you go to the grocery store, and you spend so much on gas and regular everyday things, and your children need things,” she continued. “It becomes so much of a struggle, and I’m ready for Bidenomics to be gone. I am so tired of him trying to pretend like Americans are not struggling.”

“The middle class seems to be getting smaller under Bidenomics,” she told Shimkus. “And I think the most insulting things to mothers and fathers out there right now… is they know that there is more month at the end of the paycheck every single month, and what we continue to hear from the current president of the United States is that he’s doing it right and, if you don’t believe that, then you have misunderstood, and he’ll just wait for you to come to his conclusion.”

Recent findings from the Federal Reserve’s Economic Well-Being of U.S. Households report for 2023 show that just 64% of parents with kids under the age of 18 reported doing at least OK financially last year, the lowest level since 2015 when the survey began. 

Despite outcry from working class families, President Biden insists his administration has “turned [the economy] around,” telling CNN’s Erin Burnett during a tense exchange in an interview earlier this month that Americans have had access to “good-paying jobs” under his tenure.

“When I started this administration, people were saying there was going to be a collapse of the economy. We have the strongest economy in the world. Let me say that again – in the world,” he said, despite conceding that inflation is “really worrisome to people.”

As the “Fox & Friends First” discussion circled back to Tullos, she claimed that people in the deep blue state of Hawaii are “starting to wake up,” 

“Maui, for example, still [has] no money. [People are] displaced, homeless. Everybody outside is getting the taxpayers’ money except us. It’s so sad,” she said. “And I do see more people [saying] I’m going to vote Republican… It’s not working for me. It’s not working for anybody. You cannot spell triumph without Trump.”

Tables turn on dad who goes to the internet for take on parenting moment

A father who shared his story on the popular Reddit page, known as AITA (“Am I the a–hole?”), has not been getting much love from others about what happened.

Some 5,000 people have so far reacted to his story in less than 24 hours, and the overwhelming verdict is that the hapless dad mishandled a key parenting task. 

“I have two kids, who are 2 and 4 years old,” wrote the father.

“And one thing I try to reinforce with them is that if Mom or Dad says ‘no,’ if they go to the other parent — the answer they will get is no.”

He added, “Which means if they ask my wife, and she says no, regardless of how I feel on the matter, I’m going to back her up. And I expect my wife to do the same.”

Then came the problem. 

“Well, this morning,” wrote the dad, going by the username “Acrobatic-Garbage-52,” “we were getting ready to leave and [our] 4-year-old asked my wife if she could get out a game that always makes a mess.”

The man added, “So my wife said no.”

Immediately, however, the 4-year-old then “turned to me and asked the same question.” 

So the dad replied, “No, your mom told you no.” 

The father wrote that this answer “upset my wife, and I don’t quite understand why.” and he then asked others for their opinion of how he handled it.

“The way you phrased it had an undertone of, ‘Mom is a killjoy and I might have said yes.’”

They delivered their verdicts.

In the top “upvoted” response on the platform, a commenter tried to explain to the man why he botched things.

“I think, ‘Your mom already answered you,’ is much better,” this commenter wrote.

Others also weighed in to help the dad see the light.

“I get what you were trying to do,” wrote another person, “which was teach your child that if they get a ‘no’ from one parent, they shouldn’t ask the other parent. But the way you phrased it [had] an undertone of, ‘Mom is a killjoy and I might have said yes.’”

Another person responding to the dilemma put it this way, “The problem is not with what you are doing, but how you are phrasing it.”

This person said, “Your phrasing can be taken to mean, ‘I might have said yes, but your mother said no’ — thereby making her the bad guy.”

“Talk with your wife. Find out why this upset her.”

The person went on, “Your kids are too young to understand the kind of ‘united front’ setup that you want to emphasize, therefore you need to stick just with something that is more like ‘No.’ or ‘No, you were already told no.’”

Another person on Reddit who commented shared a thoughtful message with the young father.

“Talk with your wife. Find out why this upset her,” the person wrote, in part. “Make a plan of action of how to deal with it in the future.”

Yet another commenter shared a similar but far more pointed message.

“You should be asking your wife why she’s upset, not Reddit,” said this commenter.
