DOJ sues after deep red state allegedly tries to remove noncitizens from voter rolls

The Department of Justice sued the State of Alabama and its top election official, alleging that they had removed voters who had previously been issued noncitizen identification numbers from its election rolls too close to election day.

Noncitizen identification numbers are a tax-processing number issued by the Internal Revenue Service (IRS) to ensure that people—including undocumented immigrants—pay taxes. Along with paying taxes, noncitizen identification numbers can provide legal migrants with securing a driver’s license and providing proof of residency.

After being sworn into office in January, Alabama Secretary of State Wes Allen got to work to identify and remove 3,251 individuals who are registered to vote in Alabama who have been issued noncitizen identification numbers by the Department of Homeland Security.

“I have been clear that I will not tolerate the participation of noncitizens in our elections,” Allen previously said in a release. “I have even gone so far as to testify before a United States Senate Committee regarding the importance of this issue. We have examined the current voter file in an attempt to identify anyone who appears on that list that has been issued a noncitizen identification number.”

ALABAMA ELECTION OFFICIALS SAYS BIDEN EXECUTIVE ORDER GIVES ILLEGAL IMMIGRANTS ‘MECHANISM’ TO REGISTER TO VOTE

Now, the DOJ is pushing back and has filed a lawsuit against Alabama and Allen.

The agency argued that Allen violated the National Voter Registration Act of 1993 (NVRA), which requires states to complete any changes to the voter registration lists no later than 90 days before federal elections.

Allen implemented the changes 84 days before, the DOJ alleged.

“The right to vote is one of the most sacred rights in our democracy,” Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division said in a statement. “As Election Day approaches, it is critical that Alabama redress voter confusion resulting from its list maintenance mailings sent in violation of federal law.

ALABAMA SECRETARY OF STATE ALLEN ANNOUNCES WITHDRAWAL FROM VOTER REGISTRATION GROUP

The DOJ also alleged that Allen’s removal of voter registration also impacted natural-born citizens who were incorrectly identified as potential noncitizens.

The Justice Department seeks injunctive relief that “would restore the ability of impacted eligible voters to vote unimpeded on Election Day,” the department said in a statement.

“The department also seeks remedial mailings to educate eligible voters concerning the restoration of their rights and adequate training of local officials and poll workers to address confusion and distrust among eligible voters accused of being noncitizens,” the agency said.

Reached for comment late Saturday night, Alabama Secretary of State Wes Allen told Fox News Digital, “I was elected Secretary of State by the people of Alabama, and it is my Constitutional duty to ensure that only American citizens vote in our elections.

“As to the question regarding the Department of Justice’s lawsuit, this office does not comment on pending litigation where the Secretary of State is a named defendant.”

Parents on island paradise afraid as migrants allegedly causing rare, heinous crimes

Local parents fear for their kids’ safety after federal agents nabbed five illegal immigrants, including a member of the notorious gang MS-13, for alleged crimes that include sexual assault of children on this picturesque island.

Erik Evans, who has lived on the Massachusetts island off Cape Cod for 31 years and has an 8-year-old daughter, told Fox News Digital the arrests earlier this month by Immigration and Customs Enforcement underscore how the town has changed in recent years.

The surging migrant population that largely serves the summer crowd remains when the weather turns cold, and a handful have allegedly committed crimes rarely seen here.

WEALTHY, LIBERAL NANTUCKET, MARTHA’S VINEYARD SEE 6 ICE ARRESTS IN ONE MONTH, INCLUDING MS-13 GANG MEMBER

“How are these past five people that have gotten arrested that are rapists and [violent criminals] working here and walking through our grocery store and passing by us at the gas station? It just … it’s not what Nantucket once was,” Evans said.

“I’m very happy that ICE was here and was able to do their job and get rid of at least some of the bad people that are on the island. There’s obviously many, many more. And, as a community, it scares me. As a father, it truly scares me, and I would like to see more being done.”

Evans, a construction worker, said the island’s wealthy seasonal residents who want “everything done yesterday” have attracted an influx of illegal migrants.

Tommy Hilfiger, former Secretary of State John Kerry, actor Ben Stiller and actress Kathie Lee Gifford are among the rich and powerful who own homes on the idyllic island with a population of about 14,000.

“They can cut wood or they can bang nails,” Evans said. “And, you know, I wonder who’s hiring these people. Do they do background checks on them?”

On Sept. 10, 28-year-old Salvadoran migrant Bryan Daniel Aldana-Arevalo was charged with one count of child rape with a 10-year age difference and two counts of indecent assault and battery on a child under 14.

ERO Boston Field Office Director Todd Lyons said Aldana-Arevalo “represents a significant danger to the children of our Massachusetts communities” in a press release at the time of his arrest. His alleged victim was just 12 years old, the Nantucket Current reported.

That day, Aldana-Arevalo and Elmer Sola, another Salvadoran migrant charged with 11 counts of sex crimes against a child, which Lyons said took place in Nantucket, were quietly taken to the mainland in handcuffs via ferry.

Sola was arraigned, charged and released with an ankle monitor Aug. 14 on the condition he stay away from the victim and the victim’s family, according to the Nantucket Current. But, nine days later, he returned to court after allegedly violating the pretrial conditions of his release.

AOC’S ‘RED LIGHT’ DISTRICT OVERRUN WITH PROSTITUTES AS LOCALS CALL OUT MIA ‘SQUAD’ MEMBER

On Sept. 11, agents returned to the iconic vacation site to arrest illegal Brazilian migrant Geon do Amaral Belafronte and Guatemalan illegal immigrant Felix Alberto Perez-Gomez. Both had committed sex crimes against Nantucket residents, Lyons said.

Belafronte entered the U.S. lawfully in 2018 but left of his own volition after the alleged assault took place in 2021. He reentered the country illegally and was picked up on an arrest warrant in March. After his arraignment, Nantucket District Court released him on $500 cash bail or a $5,000 surety bond, according to court records and Boston ERO.

According to a police report reviewed by the Nantucket Current, Belafronte pinned his alleged victim to the ground with her hands over her head and said “I will rape you” as he licked her lips with his tongue while she kept her mouth closed.

Reputed MS-13 gang member Angel Gabriel Deras-Mejia of El Salvador was taken into custody by the agency on the island Sept. 12. Lyon said Deras-Mejia “represent[ed] a significant threat to the residents of Nantucket.”

TENS OF THOUSANDS OF ILLEGAL IMMIGRANTS WITH SEXUAL ASSAULT, MURDER CONVICTIONS ROAMING US STREETS: ICE DATA

Deras-Mejia was arrested at the Discovery Playground on Old South Road in July. Nantucket Police wrote that he was “drunk and cursing, flaring his arms, yelling loudly and distracting all civilians who were at the scene” and left children at the scene crying. Allegedly, he and the mother of his child were arguing about who would take their child home, according to the Nantucket Current. In August, he was arrested again for assault and battery on a household member.

Another Nantucket father, who asked not to be named, noted that one of the gang member’s arrests took place right beside his daughter’s preschool.

“It’s a little scary, knowing there are people like that living here,” the father said outside The Muse, a watering hole frequented by locals. “The reaction from some people is that ‘[Immigrants here] are scared [after the ICE arrests].’ Well, I have kids, and I think it’s scary these people are living here.”

A 39-year-old woman who has lived in Nantucket since she was 4 years old and has a daughter enrolled at Nantucket Intermediate School, told Fox News Digital the particulars of the illegal migrants’ crimes – and the reactions of her neighbors and friends to the ICE raid — were disquieting.

“On Facebook, the [local newspaper] is covering it a lot. They’ll post it, and nobody will say anything,” she said. “I feel like people are scared to say, you know, like, ‘Good for [ICE]. Glad this is happening.’ You know, it’s crickets.”

“Of course I do,” Evans said when asked whether he had had concerns about his child’s safety in the community after the arrests.

“My daughter goes to school, and after school, she goes over to the Boys and Girls Club. But, I mean, they walk there. … And the number of kids, there’s never enough chaperones or people that can really keep an eye on all of these kids,” he said.

Evans told Fox News Digital there are “Ring doorbell cameras everywhere” these days on Nantucket and that a number of “big-time alarm system companies” have cropped up on the island in recent years.

“Our local paper comes out every Thursday. And the crime report … is dramatically much larger in the past few years than what it used to be,” he said. “There’s always at least 15 to 20 different people that are in the court report, and those episodes stem anywhere from a lot of drunk driving, OUI arrests, [and] many home invasions. Domestic abuse drugs.

“Obviously, you know, we’re not really sure where there is a safe place anymore.”

Before this month, immigration officials had not come to the island to carry out arrests since 2017, Boston ERO told Fox News Digital.

“I never foresaw what we have now,” Evans said. “And it’s only going to get worse before it gets better.”

Gov Walz gets anything but a warm sendoff after Michigan-Minnesota game

A rough afternoon for Minnesota Gov. Tim Walz got even tougher.

Vice President Kamala Harris’ running mate attended Saturday’s game between Minnesota and Michigan in Ann Arbor, taking in the action from a suite along with former U.S. Rep. Beto O’Rourke.

The Golden Gophers trailed by as many as 17 points early, but they staged a late comeback by scoring three touchdowns in the fourth quarter.

However, it was too little too late, and the 12th-ranked defending champions came away with a 27-24 victory.

When it came time for Walz to exit the Big House, fans waited outside and gave him a harsh farewell.

Several in attendance booed him, with another fan even yelling “Get out of here.”

Minnesota cut it to a three-point game with 1:36 to go, and it recovered an onside kick, but a special teamer was ruled offside, negating the play, and the Wolverines ran out the clock.

Before the game, Walz was tailgating with fans outside the Big House.

“A little rain can’t keep us from the big Michigan-Minnesota game! And it’s not gonna stop these students from making sure that everyone on their campus is registered to vote,” Walz posted on X.

When asked by the Michigan College Democrats on X whether he was “excited for Michigan to beat Minnesota today,” he let out a laugh, perhaps knowing it was unlikely.

“I’m excited to be at the Big House. I’m excited to watch this incredible game. I’m more excited to see young people being excited about their future,” he responded.

When he was done tailgating, Walz and his wife took the field to greet Minnesota head coach P.J. Fleck.

The Wolverines are 5-1 and have won four straight since their loss to Texas, which is now ranked No. 1 in the country. The Gophers are 2-3, losing both of their conference games.

Alabama fights back for win after squandering own 28-point lead to No. 2 Georgia

The game everyone had circled on their calendars lived up to the hype, and some.

Saturday’s Alabama-Georgia contest was a rematch of last season’s SEC title game, which Bama won as the eighth-ranked team in the country – Georgia had been ranked No. 1 after winning 42 of their previous 43 games, but Bama’s victory propelled them into the College Football Playoff, and knocked Georgia out.

Well, it was simply epic.

After squandering their own four-touchdown lead, No. 4 Alabama scored a late touchdown to come away with a 41-34 win over No. 2 Georgia in an instant classic.

Alabama scored four touchdowns in the first 18 minutes of the game to take a commanding 28-0 lead, but Georgia fought all the way back. Trailing 33-15, Georgia found the end zone when they desperately needed it, but failed the two-point attempt. However, after forcing a punt, the Bulldogs scored again, and all of a sudden, Bama’s lead shrunk to just four points. Georgia then forced another punt, all while Bama did not waste the clock, getting the ball back for a shot at the lead with 2:42 to go and all their timeouts.

Well, it only took one play for Georgia to take the lead, as Carson Beck found Dillon Bell for a 67-yard score to go up, 34-33. Beck’s rush on the two-point conversion was short, but nonetheless, the comeback was complete, and Bama, who had dominated early, suddenly was in desperation mode.

No worries – it was the 17-year-old, Ryan Williams, who took a 75-yard pass from Jalen Milroe to the house, and after a successful two-point conversion, Bama was back up seven points.

The Bulldogs faced a 4th and 2 with 1:22 to go at the Bama 47, and Beck found Colbie Young for the first down, and three plays later, the Bulldogs were in the red zone. But, Beck was intercepted after going in the end zone, and with the touchback, Bama was able to knee out the clock to get the victory.

Georgia finally scored a touchdown midway through the second quarter. However, Beck was called for an intentional grounding in his own end zone, resulting in a safety later on. But apparently, despite trailing 30-7, all Georgia needed was halftime.

Beck found Arian Smith for a 12-yard touchdown for the first score of the third quarter. They took a big risk in going for two, but it was successful. A Bama field goal, though, made it a three-possession game late in the third. On Georgia’s ensuing drive, Beck lost a fumble. But they weren’t dead, and the comeback began on their next drive. However, they couldn’t get a stop when they needed it most, and Beck’s final turnover came at the worst time.

The game is Georgia’s first loss of the season, and after losing just one in a 43-game stretch, they’ve now lost two in their last five. They are 45-3 in their last 48 games, but all three losses have come to Alabama (although, one of those victories is the national championship in 2022 against the Crimson Tide). Bama, meanwhile, improved to 4-0.

Milroe finished with 373 yards on 27-for-33 passing, throwing two touchdowns and running for another two. The 17-year-old Williams made sx catches for 177 yards and a touchdown. Beck turned the ball over four times, but still managed to throw for 439 yards. Smith went for 132 yards, while Bell added 100.

The game was also headlined by Donald Trump’s appearance. The former president, and current Republican nominee, received an ovation from fans while walking in the halls and when he was shown on the jumbotron.

Fans cheer as Trump arrives at Alabama-Georgia showdown: ‘Four more years’

For the first time this year, Donald Trump is in the building for a college football game.

The former president and three-time Republican presidential nominee is in Tuscaloosa to attend Saturday night’s game between Alabama and Georgia.

Trump began his day in Wisconsin for a rally, which was supposed to take place outside, but it was moved indoors due to a Secret Service staffing shortage.

Afterward, he flew to Alabama to take in the action between the two top-four SEC programs.

When Trump arrived, dozens of fans were in the concourse of Bryant-Denny Stadium to greet him.

Trump threw merchandise to fans, and many of them chanted “USA” as he entered the stadium.

Trump also received an ovation once he was shown on the jumbotron.

Last year, he attended a game between Iowa and Iowa State and another between Clemson and South Carolina. He attended an Alabama game in 2019, too.

Given recent assassination attempts on the former president, including one on his own golf course, acting Secret Service director Ronald Rowe was asked if “[these] types of events are particularly concerning, given (there) could be around tens if not hundreds of thousands of people” at Saturday’s game. Bryant-Denny Stadium holds over 100,000 people.

But Rowe said his teams “know what they have to do to make a secure environment for our protectees.”

Vice President Kamala Harris has reportedly arranged for a banner trolling Trump during the game.

A plane with the message “Trump’s Punting on 2nd Debate” is expected to fly over the stadium during the primetime matchup, The Washington Post reported Saturday.

Alabama defeated Georgia 27-24 in the SEC title game last season. It put the Crimson Tide in the College Football Playoff as the No. 4 seed, and it knocked out Georgia, which had been No. 1 and had won 42 of its previous 43 games. History is looking to repeat itself after Alabama took a 21-0 lead in the first quarter.

Ellen DeGeneres describes startling health diagnoses during special

Ellen DeGeneres revealed that she has been diagnosed with osteoporosis, obsessive-compulsive disorder and ADHD.

During her final Netflix special “For Your Consideration, which premiered on Tuesday, the 66-year-old comedian opened up about her recent triple diagnosis as she got candid about aging.

DeGeneres recalled that she took a “stupid bone density test” at the recommendation of her doctor and learned that she had “full-on osteoporosis.”

“I don’t even know how I’m standing up right now. I’m like a human sandcastle. I could disintegrate in the shower,” she told the audience.

Osteoporosis is a “bone disease that develops when bone mineral density and bone mass decreases, or when the structure and strength of bone changes. The disease can “lead to a decrease in bone strength that can increase the risk of broken bones, per the National Institute of Arthritis and Musculoskeletal and Skin Diseases.

ELLEN DEGENERES TO LEAVE HOLLYWOOD AFTER NETFLIX SPECIAL: ‘THIS IS THE LAST TIME YOU’RE GOING TO SEE ME’

Nearly 20% of women aged 50 and over have osteoporosis, according to the Centers for Disease Control and Prevention.

DeGeneres went on to admit that “it’s hard to be honest about aging and seem cool,”

“I had excruciating pain one day and I thought I tore a ligament or something and I got an MRI and they said, ‘No, it’s just arthritis.’ I said, ‘How did I get that?’ And he said, ‘Oh it just happens at your age,'” the former “Ellen” actress said.

DeGeneres also shared that her therapist diagnosed her with obsessive-compulsive disorder (OCD). The “Finding Dory” told the audience that she entered therapy as she was “trying to deal with all the hatred that was coming at me.”

“I’m like a human sandcastle. I could disintegrate in the shower.”

— Ellen DeGeneres

In July 2020, DeGeneres’ long-running daytime talk show “The Ellen DeGeneres Show” was rocked by toxic workplace accusations from former, as well as allegations of sexually inappropriate behavior by ousted producers. DeGeneres issued an apology to her staff in a statement and apologized again on-air during the premiere of the show’s 18th season in September 2020.

In 2021, DeGeneres announced that her show would be ending after its 19th season. The final episode aired in May of 2022.

During her Netflix special, DeGeneres said “I may have OCD because a therapist said so and I said, ‘Yes I am very organized,’ because I thought that was the O.”

“I didn’t know what OCD was,” she continued. “I was raised in a religion, Christian Science, that doesn’t acknowledge diseases or disorders. So when I was growing up, nobody talked about anything. There was no discussion of anything.”

“I look back now and I realize my dad for sure had OCD,” DeGeneres said of her late father Elliott.

She continued, “He would check the doorknob 15 times before we’d leave, he’d check the faucet 15 times, he would unplug all the appliances before we left the house because lightning could strike and it could catch fire. They say it could be hereditary.”

Per the National Institute of Mental Health, OCD is a “long-lasting disorder in which a person experiences uncontrollable and recurring thoughts (obsessions), engages in repetitive behaviors (compulsions), or both.”

The comedian said that after her therapy session, she asked her wife Portia de Rossi if she thought that DeGeneres might have OCD.

“And she said, ‘Yes, you do,’” DeGeneres recalled. “Barely got that sentence out really. It’s funny. I’ve never thought of myself as obsessive. I think of myself as careful and everyone else careless and out of control.”

In addition, DeGeneres shared that she has attention deficit disorder (ADD), which is now referred to as ADHD (attention deficit hyperactivity disorder).

ADHD is a “developmental disorder marked by persistent symptoms of inattention and/or hyperactivity and impulsivity that interfere with functioning or development,” per the National Institute of Mental Health.

“My ADD makes it really hard to sit down and focus on anything at all,” DeGeneres said.

“I mean, do you know how hard it was for me to put this together?” she added of her special.

“Of course you don’t,” DeGeneres continued. “Why would I ask that question? Why would I ask that question? Why do people ask people questions they know they don’t have the answer to?”

“It’s hard for me to focus,” DeGeneres admitted as the audience laughed.

“So, I have ADD, I have OCD, I’m losing my memory,” she said. “But I think I’m well-adjusted because I obsess on things, but I don’t have the attention span to stick with it, and I quickly forget what I was obsessing about in the first place.”

“So, it takes me all the way around to being well-adjusted, I think.”

At the end of her special, which she has said will be her last before she retires, DeGeneres thanked her audience.

DeGeneres admitted that in the past, she “has cared far too much what other people think of me.”

“But with time you gain perspective, which is one good thing about aging,” she said. “It doesn’t totally make up for arthritis or brittle bones. But with perspective, you realize that caring what people think to a degree is healthy, but not if it affects your mental health.”

“So after a lifetime of caring, I just can’t anymore. So I don’t,” she said as the audience cheered.

DeGeneres continued, “But if I’m being honest — and I have a choice of people remembering me as someone who was mean, or someone who is beloved.”

“Beloved,” she added. “I choose that.”

Sarah Ferguson praises ‘brave’ royals for speaking up during cancer journeys

Sarah Ferguson praised Kate Middleton and King Charles III for their transparency about their cancer journeys.

The Duchess of York, 64, who has publicly battled two types of cancer, expressed her admiration for the 42-year-old Princess of Wales and the 75-year-old monarch, both of whom revealed their cancer diagnoses earlier this year.  In February, Buckingham Palace announced that Charles had been diagnosed with a form of cancer and was undergoing treatment.

In March, Middleton disclosed her own cancer diagnosis and shared that she was undergoing preventative chemotherapy. In a heartfelt video shared earlier this month, the royal revealed that she was cancer-free after completing her treatment. The mother of three acknowledged it had been an “incredibly tough” year for her family, but said her cancer battle had reminded her to “be grateful for the simple yet important things in life” such as “loving and being loved.”

Middleton also thanked supporters for their kindness and compassion and told those fighting cancer that she remains by their sides.

“I think they are an example to all families going through their own journeys of health,” Ferguson told People Magazine. “I think both the King and the Princess of Wales have spoken openly about their journey, and I love that the Princess says, ‘I’m always there for you.’ I love that video. It was a beautiful video with beautiful words.”

“The King, you know, became the patron of the Cancer Research UK, which is such a big organization, and he actually went out to meet the patients,” she noted.

SARAH FERGUSON, DUCHESS OF YORK, ADMITS ‘SHOCK’ FROM 2ND CANCER DIAGNOSIS WITHIN A YEAR: ‘BE DILIGENT’

On April 30, Charles and his wife Queen Camilla visited the University College Hospital Macmillan Cancer Centre where he met with medical specialists and patients. The visit marked the first time that the monarch returned to public-facing royal duties after taking a three-month break while he received treatment and recuperated following his diagnosis. On the same day, it was announced that Charles had become the patron of Cancer Research UK, the world’s largest independent cancer research organization.

“I think both the King and the Princess of Wales have spoken openly about their journey, and I love that the Princess says, ‘I’m always there for you.’ I love that video. It was a beautiful video with beautiful words.”

“That was very brave too, very courageous, and [he] spoke openly, which was very important to help people and give hope,” Ferguson said.

Ferguson has also been open about her own health struggles after she was diagnosed with breast cancer and skin cancer within the same year. In June 2023, Ferguson’s representative announced that the duchess had been diagnosed with an “early form of breast cancer” during a routine mammogram. Ferguson subsequently underwent a single mastectomy and breast reconstruction.

The duchess spoke candidly about her diagnosis on social media and in episodes of her “Tea Talks” podcast and urged her followers to be vigilant about their health.

In January, Ferguson revealed that after overcoming breast cancer, she had been diagnosed with malignant melanoma. During the reconstructive surgery following her mastectomy, Ferguson had moles removed which were then tested. One of the moles was determined to be cancerous.

“Naturally another cancer diagnosis has been a shock but I’m in good spirits and grateful for the many messages of love and support,” Ferguson wrote the caption of an Instagram post. “I believe my experience underlines the importance of checking the size, shape, color and texture and emergence of new moles that can be a sign of melanoma and urge anyone who is reading this to be diligent.”

In May, Ferguson’s daughter Princess Beatrice shared a positive update on her mother’s health. The duchess shares Beatrice, 36, and Princess Eugenie, 34, with her ex-husband Prince Andrew of York.

“She’s doing really well,” Beatrice said on ITV’s “This Morning,” per The DailyMail. “She’s had a bumpy health scare last year, but [she’s] all clear now… I think at 64, she’s thriving. She’s been through so much. I think really now she’s sort of coming into her own.”

During her interview with People Magazine, Ferguson opened up about the current state of her health and how her back-to-back health scares have affected her.

“I think that you never really get rid of the worry about health. For every sort of melanoma, you never really know where it is. You look at everything and you’re certainly more aware,” she said. “It’s been an extraordinary journey to have gone through a mastectomy, and then you have to keep having checks, and then you think you’re going to get it again. It’s a lot of very fragile mind work.”

“I think that also gives me empathy to understand the fragility of the mind,” Ferguson added. “A lot of young people have fragile, vulnerable times, with cyberbullying and chronic cruelty from other people. I think that’s something I address, I am adamant about cruelty through social media.”

“My health is really good now, but you have to be a bit more cognitive and not push yourself too much, which I do.”
