Texas Republicans pounce on planned Harris event: ‘One of the dumbest political decisions’
FIRST ON FOX: More than a dozen Texas Republicans, from the governor to members of the U.S. House, slammed Vice President Kamala Harris’ planned visit to the border state Friday, telling Fox News Digital the visit is “one of the dumbest political decisions” they’ve seen.
“‘Border Czar’ Kamala Harris can come all the way to Houston where Jocelyn Nungaray was killed by Tren de Aragua gang members that she let into the country, yet she can’t be bothered to visit Jocelyn’s family or even say her name. Kamala Harris and her open border policies have allowed over 11 million illegal immigrants and dangerous criminals like TdA into our country, putting every American’s life at risk,” Texas Gov. Greg Abbott told Fox News Digital.
“President Donald Trump has shown real leadership on the border, with successful border policies that decreased illegal immigration to the lowest level in decades. While Kamala Harris refuses to take real action on this crisis, Texas will continue to step up with our historic border mission until we have a partner in the White House to make America secure again.”
Harris will travel to the red state just 10 days ahead of Election Day, and she is expected to speak about the state’s abortion policies after the Supreme Court overturned Roe v. Wade in 2022. Abortion is a hallmark of the Harris campaign, including Harris saying she supports eliminating the filibuster in an effort to pass a law restoring abortion access nationwide.

Harris will be joined by Democratic Senate candidate Colin Allred, who is making a long-shot run to unseat longtime Republican Sen. Ted Cruz.
Cruz slammed his Senate opponent in comments to Fox Digital, saying Allred and Harris share the same “radical policies.”
“Colin Allred is Kamala Harris. They have spent the last four years working hand-in-hand against Texans and the American people with their radical policies, whether those be pushing to allow boys in girls’ sports, allowing dangerous illegal aliens to come into our country or trying to destroy the oil and gas industry in Texas,” Cruz said.

As illegal immigration spiraled in 2021, the Biden-Harris administration’s first year in office, President Biden announced Harris would lead the effort to determine the “root causes” of immigration. The administration pointed to issues such as climate change, poverty and violence driving migrants to the U.S.
The media and Republicans dubbed Harris the “border czar” shortly after, with the White House rejecting the title. The moniker, however, has continued years later, including Texas Republicans this week using it to slam Harris ahead of her visit.
“Millions of migrants have illegally entered our country on Border Czar Kamala Harris’ watch, so it’s no surprise that she’d rather talk about anything but her abysmal track record on the border. If she can’t control the border, how can she run the country? We’ve never had a more secure border than under President Trump, and he will put a stop to this when he takes office. Nineteen Texas leaders submitted comments to Fox News Digital slamming Harris’ planned visit, with a handful citing girls and women who have been murdered in recent years, allegedly at the hands of illegal immigrants.
“Harris should visit Houston, but not to campaign. She should come to apologize for purposefully allowing Texas border counties to be overrun and allowing young Houstonians like Jocelyn Nungaray to be murdered by the people she allowed in,” Rep. Dan Crenshaw said.
Twelve-year-old Jocelyn Nungaray was sexually assaulted and murdered by strangulation when two illegal immigrants in their 20s allegedly lured the young girl under a bridge before killing her in June.
“Instead of coming to Texas to ask for our votes, Kamala should be asking for our forgiveness. Especially from the family of Jocelyn Nungaray and the countless others devastated by her administration’s open border policies. For four years, she has ignored Texans and the deadly crisis she has created at our southern border,” Rep. Roger Williams said.
“Her negligence as Border Czar contributed to the tragic deaths of Americans, including Jocelyn Nungaray, who was killed by two illegal aliens from Venezuela. Young women like Laken Riley, Jocelyn Nungaray and Rachel Morin would be alive today if Kamala Harris had taken her responsibilities seriously,” Rep. Wesley Hunt added.
Harris’ event will kick off Friday evening in Houston, with reports surfacing that she will be joined by singer-songwriter Beyoncé, who is originally from Houston.

The Harris campaign did not immediately respond to Fox News Digital’s request for comment on the Texas Republicans’ comments on her upcoming visit. The campaign also did not respond to a request for confirmation regarding whether Beyoncé will join the rally.
Harris joined a CNN town hall on Wednesday evening outside Philadelphia, where moderator Anderson Cooper pressed the vice president about her border policies, including whether she supports a border wall after calling the wall “stupid” when it was championed by Trump during his administration.

“Let’s talk about Donald Trump and that border wall,” Harris said while laughing. “So, remember, Donald Trump said Mexico would pay for it. Come on, they didn’t. How much of that wall did he build? I think the last number I saw was about 2%. And then when it came time for him to do a photo op, you know where he did it? In the part of the wall that President Obama built.”
“But you agreed to a bill that would earmark $650 million to continue building that wall,” Cooper pressed.
“I pledge that I am going to bring forward that bipartisan bill to further strengthen and secure our border. Yes, I am, and I’m going to work across the aisle to pass a comprehensive bill that deals with a broken immigration system,” Harris responded.
“So you don’t think it’s stupid anymore?” Cooper continued.

Texas Attorney General Ken Paxton railed against Harris in comments to Fox Digital ahead of her visit, saying she and President Biden “intentionally dismantled every successful Trump border policy to let in as many aliens as possible” starting on their first day in office.
“Now, Kamala wants to come to Texas and talk about border security after four years of destroying American communities. If she wanted a secure border, why did I have to sue her administration dozens of times to force them to follow federal immigration laws? We’re fighting Kamala’s destructive open-borders doctrine in the courts because she has unlawfully weaponized power to make our country more dangerous instead of keeping Americans safe,” Paxton said.

Ivy League professors call for ‘militant democracy’ to block Trump from presidency
Harvard professors Steven Levitsky and Daniel Ziblatt advised pushing a “militant democracy” to ensure an “authoritarian figure” like former President Trump never rises to power again.
In an op-ed for the New York Times, Levitsky and Ziblatt describe how they spent the last year “researching how democracies can protect themselves from authoritarian threats from within,” lamenting how close Trump remains to getting a second term.
“How could such an openly authoritarian figure have a coin flip’s chance of returning to the presidency? Why have so many of our democracy’s defenses seemingly broken down, and which, if any, remain?” they wrote.
One of the ways they suggested limiting figures like Trump’s rise to power was a “militant or defensive democracy” which they described as a way authorities can restrict or outlaw speech against “antidemocratic forces.”

Though they acknowledged “significant drawbacks” that could be “easily abused” in this strategy by politicians, they argued how it may be better than simply relying on electoral competition or the “laissez-faire approach” to sort out bad ideas.
“Electoral competition is, of course, essential to democracy. But a laissez-faire approach has two important limitations. First, in the United States, competition is distorted by an 18th-century institution, the Electoral College, that allows election losers to win power. In one sense, the electoral marketplace worked in 2016 the way it is theoretically supposed to: More Americans voted for Hillary Clinton than for Mr. Trump. But the Electoral College permitted an authoritarian figure who won fewer votes to become president,” they wrote. “In addition, history shows us that electoral competition alone is insufficient to fend off extremist threats. Good ideas don’t always win out. And candidates seeking to subvert democracy don’t always lose.”
Levitsky and Ziblatt criticized the “tepid” approach from politicians as well as leading businesses and religious institutions on calling out or limiting Trump’s rise.

VP Harris used one word dozens of times when pressed on policy at town hall
Vice President Kamala Harris mentioned former President Trump by name more than two dozen times during her CNN town hall on Wednesday, including when pressed about specific policies she would institute if elected to the White House.
Fox News found that during the CNN town hall in Chester, Pennsylvania, Harris mentioned Trump by name 26 times, while Trump was mentioned overall by moderator Anderson Cooper or audience members a total of 43 times. The CNN town hall kicked off at 9 p.m. on Wednesday and wrapped up around 10:15 p.m.
Harris was pressed on issues such as her border policies the last three and a half years as vice president, and how she would tackle immigration differently if she was elected president. At one point, Cooper pressed Harris on her support of a bipartisan bill that would provide funding for a border wall that she previously lambasted as a “stupid” idea when promoted by Trump during his administration.

Harris accepted the debate, but Trump declined, spurring the network to host a town hall instead.

Harris was also asked about codifying Roe v. Wade, which sparked the vice president to again attack Trump while signaling support to end the filibuster.
“You’ve talked about codifying Roe v Wade. That would require 60 votes in the Senate, a majority of the House. That’s a big— that’s a big leap. We don’t have that yet. If that’s not possible to codify it in the House, what do you do?” Cooper asked.
“I think we need to take a look at the filibuster, to be honest with you. But the reality of it is this, let’s talk about how we got here. When Donald Trump was president, he hand-selected three members of the United States Supreme Court with the intention that they would undo the protections of Roe v Wade,” she said. “And they did as he intended. And now, in 20 states, we have abortion bans.”

Harris was directly asked about Trump a handful of times during the debate — with her answers included in the total count of 26 Trump mentions — most notably when Cooper asked her about an X post comparing Trump to Nazi Germany dictator Adolf Hitler. Earlier Wednesday, former Trump administration chief of staff John Kelly claimed to the media that Trump praised “Hitler’s generals” for their loyalty, which Harris repeated in an X post that day.
“If the president of the United States, the commander in chief, is saying to his generals, in essence, ‘Why can’t you be more like Hitler’s generals?’ Anderson, come on. This is a serious, serious issue. And we know who he is. He admires dictators, sending love letters back and forth with Kim Jong Un,” Harris said at one point. She also told Cooper that she believes Trump is a “fascist.”

If it’s on the wrong track, that track follows three and a half years of you being vice president and President Biden being president. That is what they’re saying, 79% of them. Why are they saying that?” Fox News chief political anchor Bret Baier asked Harris during the interview. “If you’re turning the page, you’ve been in office for three and a half years.”
“And Donald Trump has been running for office since…” Harris responded, while Baier interjected, “But you’ve been the person holding the office.”
At another point, Baier asked Harris: “Your campaign slogan is a ‘New way forward’ and ‘It’s time to turn the page.’ You’ve been vice president for three and a half years, so what are you turning the page from?”

“Well, first of all, turning the page from the last decade in which we have been burdened with the kind of rhetoric coming from Donald Trump that has been designed and implemented to divide our country and have Americans literally point fingers at each other. Ruling from swing state’s high court could give thousands a second chance to cast vote
The Pennsylvania Supreme Court ruled Wednesday that the state must count provisional ballots for voters whose mail-in ballots were rejected or improperly filled out in a 4-3 decision that could provide thousands of voters in the state with a second chance to cast their vote.
The ruling is the latest in a string of defeats for Republicans, who have filed nearly 100 election-related court challenges in recent weeks in what they say are legal challenges aimed at preventing voter fraud through absentee and mail-in ballots.
Many of them have been filed in swing states considered pivotal for either candidate to win the presidency.
In Pennsylvania, the RNC had appealed a lower court decision that allowed voters who mistakenly sent their mail-in ballots without an inner “secrecy” envelope to cast in-person provisional ballots at their local polling location.
The Pennsylvania Supreme Court upheld that decision in a 4-3 vote, siding with a lower court that had ruled that a local election board in Butler County had been wrong this year when they disqualified provisional ballots cast by several residents in the 2024 primary election.

Writing for the majority, Justice Christine Donohue said provisional ballots exist as a “failsafe” for eligible voters in Pennsylvania to protect against disenfranchisement.
The court noted that provisional votes can be counted only after a person’s eligibility to vote and the rejection of their mail-in ballot are confirmed.
“Counting Electors’ provisional ballots, when their mail ballots are void for failing to use a Secrecy Envelope, is a statutory right,” Donahue wrote, adding that the rule in question is “intended to alleviate potential disenfranchisement for eligible voters.”
It is unclear how many residents in Pennsylvania will be impacted by the decision, and the Republican Party did not immediately respond to Fox News’s request for comment.
Still, the decision comes as Democrats have sought to position themselves as the party that supports free and fair elections, seizing on Republican lawsuits as a means of disenfranchising voters.
To wit, they have invested some six figures in a voter registration campaign to help mobilize U.S. residents living abroad. In the U.S., party efforts seek to educate voters in key swing states on how and when to vote.
They also praised the decision in a statement Thursday, with a Democratic Party official and a spokesperson for Vice President Kamala Harris’s campaign describing the court’s ruling as a rejection of “bogus legal claims.”

Expert says liberal DA throwing ‘Hail Mary’ with Menendez case as he fights for political survival
Los Angeles County District Attorney George Gascon threw a “Hail Mary” on Thursday when he announced that he would be recommending that the Menendez brothers be re-sentenced for the 1989 murder of their parents as he fights for his political life amid a tough re-election campaign, a legal expert said.
Gascon said he would recommend a sentence of 50 years to life for each of the brothers – Erik and Joseph “Lyle” Menendez – which would make them immediately eligible for parole under state law because they were under 26 at the time of the slayings.
“The guy who is down 30 points in his re-election bid threw his Hail Mary today, and he is letting out the Menendez brothers,” criminal defense attorney David Gelman told Fox News Digital. “They’re eligible for parole, and he’s going to make sure that happens. It is a terrible day for the criminal justice system.”

Gascon’s campaign declined to comment on the matter. Fox News Digital has reached out to the DA’s office.
The Menendez brothers were sentenced in 1996 to life in prison for the murders of Jose and Mary “Kitty” Menendez in their Beverly Hills mansion. The pair said they had been sexually abused by their father, but prosecutors argued that money was the motive behind the slayings.
During the murders, the brothers ran out of shotgun shells and had to go outside to get more to finish off their mother, who investigators said had blood on the bottom of her shoes, indicating that she tried to escape after the shooting began.
Some critics questioned the timing of Gascon’s announcement, given he is fighting to keep his job amid heavy criticism of his progressive criminal justice policies.

“D.A. George Gascon received the Menendez habeas corpus petition in May 2023 and request for re-sentencing in February 2024. Yet, he has waited until days before the November 5 election, 30 points down in the polls with articles coming about how his failed policies have led to additional murders of innocent people, to release his recommendation for re-sentencing,” Nathan Hochman, a former federal prosecutor running against Gascon, said in a statement.
“By releasing it now, Gascon has cast a cloud over the fairness and impartiality of his decision, allowing Angelenos to question whether the decision was correct and just or just another desperate political move by a D.A. running a losing campaign scrambling to grab headlines through a made-for-TV decision. Angelenos and everyone involved deserve better,” he added.
Gascon announced earlier that he was looking into the case after new evidence appeared to corroborate the sexual abuse allegations.
The new evidence includes allegations made public last year that their father also molested Roy Rossello, a former member of the Puerto Rican boy band Menudo, in the 1980s, and a letter that Erik Menendez wrote to his cousin, Andy Cano, that surfaced in 2015, years after the latter’s death.
Jose Menendez was an RCA records executive at the time of his death.

“They have been in prison for nearly 35 years,” Gascon said of the brothers on Thursday. “I believe that they have paid their debt to society.”
He added that a re-sentencing must be approved by the court before it becomes official and that a parole board will still need to sign off on their eventual release. He went on to praise the brothers’ good behavior during their decades behind bars.
Gascon said there was never any question that the brothers carried out the murders but to what degree of culpability should they be held accountable.
At the time of the killings, the case drew a lot of media attention. Attention resurged after the release of an eight-part Netflix true-crime drama, “Monsters: The Lyle and Erik Menendez Story,” and “The Menendez Brothers” documentary, also on the streaming platform.
Gelman noted the list of celebrities rallying around the pair, calling for their freedom.

“He (Gascon) thinks they should be released because Kim Kardashian, because Rosie O’Donnell, because Netflix, they make these guys look like martyrs. They think this is good for Hollywood.
When these two brothers get out, and they will, and they go and commit another crime, you know where the blood is?” he added. “It’s going to be on George Gascon’s hands. This is a disgrace.”
