President-elect Trump’s bid to toss his conviction in his New York criminal hush money case was denied on Friday. New York Judge Juan Merchan rejected Trump’s request to vacate the verdict in the case based on the Supreme Court’s presidential immunity decision. Sentencing is set for January 10 at 9:30 a.m, with the president-elect having the option to appear in person or virtually. But Merchan said he will not sentence the president-elect to prison. 

Bragg, in November, requested to Judge Juan Merchan that the case be stayed until the end of Trump’s second term, but Trump attorneys noted that the Office of Legal Counsel in the Justice Department concluded that “the categorical prohibition on the federal indictment of a sitting president…even if the case were held in abeyance…applies to this situation.” 

They added that Bragg’s “ridiculous suggestion that they could simply resume proceedings after President Trump leaves Office, more than a decade after they commenced their investigation in 2018, is not an option.”

Trump attorneys said the case “would never have been brought were it not for President Trump’s political views, the transformative national movement established under his leadership, and the political threat that he poses to entrenched, corrupt politicians in Washington, D.C. and beyond.” 

Biden admin trying to ban cigarettes just weeks before Trump takes office

The Food and Drug Administration (FDA) is moving forward with a regulatory rule in the final days of the Biden administration that would effectively ban cigarettes currently on the market in favor of products with lower nicotine levels, which could end up boosting business for cartels operating on the black market, an expert tells Fox News Digital.

“Biden’s ban is a gift with a bow and balloons to organized crime cartels with it, whether it’s cartels, Chinese organized crime, or Russian mafia. It’s going to keep America smoking, and it’s going to make the streets more violent,” Rich Marianos, former assistant director of the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives and the current chair of the Tobacco Law Enforcement Network, told Fox News Digital of the proposal. 

The FDA confirmed to Fox Digital on Monday that as of Jan. 3, the Tobacco Product Standard for Nicotine Level of Certain Tobacco Products had completed a regulatory review, but that the proposed rule has not yet been finalized. 

“The proposed rule, ‘Tobacco Product Standard for Nicotine Level of Certain Tobacco Products,’ is displaying in the Office of Management and Budget’s (OMB) ROCIS system as having completed regulatory review on January 3,” an FDA spokesman told Fox Digital. “As the FDA has previously said, a proposed product standard to establish a maximum nicotine level to reduce the addictiveness of cigarettes and certain other combusted tobacco products, when finalized, is estimated to be among the most impactful population-level actions in the history of U.S. tobacco product regulation. At this time, the FDA cannot provide any further comment until it is published.”

Fox New Digital reached out to the White House regarding concerns over the proposal if it were to take effect but did not receive a response.

Former President Barack Obama signed the Family Smoking Prevention and Tobacco Control Act in 2009, which granted the FDA the power to regulate tobacco products. In the years since, the agency has worked to lower nicotine levels, including in July 2017 under the Trump administration, when then-FDA commissioner Scott Gottlieb announced it would seek to require tobacco companies to drastically cut nicotine in cigarettes in an effort to help adult smokers quit.

In 2022, the FDA under the Biden administration announced plans for the proposed rule that would lower levels of nicotine so they were less addictive or non-addictive.

“Lowering nicotine levels to minimally addictive or non-addictive levels would decrease the likelihood that future generations of young people become addicted to cigarettes and help more currently addicted smokers to quit,” FDA Commissioner Robert Califf said at the time.

Lowering the levels of nicotine in commonly purchased cigarettes and other tobacco products would open the floodgates to the illicit trafficking of tobacco products into the U.S., Marianos told Fox News Digital. 

“This decision is being thrown down the public’s throat without one ounce of thought and preparation. Nobody sat down with law enforcement, nobody sat down with any doctors, No one sat down with any regulators to find out, ‘Hey, look, what are the unintended ramifications of such a poor choice,’ and that’s what I’m going to call it, a poor choice,” Marianos said. 

He explained that Mexican cartels are well-positioned to bring illegal tobacco across the border, as they do with substances such as fentanyl that have devastated communities across the U.S., while Chinese criminal organizations have some of the best counterfeit operations stretching from baby formula to cigarettes, and Russian organized crime groups have their foot in the door in cities across the nation, including in bodegas and other stores that sell tobacco products. 

Marianos said that criminal groups would likely quickly catch on to the proposal if it takes effect and subsequently amplify their tobacco operations – which he says will serve as an economic boon for the criminals. 

Americans who want to purchase cigarettes with higher levels of nicotine would then need to go through the illicit channels to obtain them, similar to buying “loosie” cigarettes on the streets of New York, putting average Americans at further criminal risk while also offering them cigarettes that are not regulated and originating from foreign nations.

Both Democrat and Republican lawmakers have already warned that tobacco trafficking in the U.S. poses a grave national security threat and already has its foot in the door. 

“In 2015, the State Department cited activity by terrorist groups, and criminal networks who have used tobacco trafficking operations to finance other crimes, including ‘money laundering, bulk cash smuggling, and the trafficking in humans, weapons, drugs, antiquities, diamonds, and counterfeit goods,’” Sens. Bill Cassidy, R-La.; Mark Warner, D-Va.; Marco Rubio, R-Fla.;  Bill Hagerty, R-Tenn.; and then-Sen. Bob Casey, D-Pa., wrote in a 2023 letter to Secretary of State Antony Blinken.

“Recently, public reporting has also noted these financial linkages between Mexican transnational criminal organizations (TCOs) involved in narcotics and fentanyl trafficking, and these tobacco smuggling activities. Mexican TCOs pose a grave threat to American national security and public health.”

Marianos added that in addition to the criminal effect posed to America and its residents, lowering nicotine levels would also defeat the stated mission of weaning smokers off cigarettes and instead lead to an increase in smoking.

“You’re going to create more smoking. And I thought that’s what we’re trying to get away from, right? Smoking is bad. I thought we’re trying to do everything possible to get away from that and get the country safer. Well, if you take down the nicotine levels, people are going to smoke more. That is proven. All you have to do is just drive here in DC and see, you know workers on their smoke break,” he said, saying work productivity will even be driven down as people take more smoke breaks in alleys to get their nicotine fix. 

The Biden administration previously attempted to outright ban menthol cigarettes, in what was described as a “critical” piece of President Biden’s Cancer Moonshot initiative, but announced last year it was abruptly delaying such regulations as the public decried the move. A handful of groups argued that banning menthol unfairly targeted minority communities, while others argued the ban would open the floodgates to illicit menthol sales.

Father Mark-Mary Ames, who was born and raised in Orange County, California in what he described as a “wealthy family,” said he was inspired by Mother Teresa to give up a life of privilege for the service of others.  

“I heard that there’s a group of Franciscans in New York who are hardcore and sleep on the ground. And I looked them up, and I read our constitutions — which are what we say we’re about — and I’m like, ‘if that’s true, that’s everything I’m looking for.’ So I was a very, very normal kid, on a normal path. And then God just sort of made this happen.”

“I’m made to give my life to the poorest of the poor,” he added. “The big, deep experience of my life is what God’s done in generosity. And so there’s nothing I’ve left behind or sacrificed that he hasn’t been repaid a hundred-fold. It’s in new and deeper ways.”

“There’s something particular that God wants to do through Mary that also continues now. So, it’s interesting that even Mary’s the one who continues to come,” he said. “I think the number one thing is [that] there seems to be some sort of special grace given by God to the Rosary where he wants to do some special work. And the rosary is the thing that unlocks it. It opens the door to grace.”

The rosary can be confusing and even intimidating for some — but the priest asserts it’s actually “perfect.”

“It took hundreds of years to be developed to get to what it is, as a perfect prayer that has our way of receiving and coming to God,” he said. “But also, it’s really good for our humanity. We’re all over the place. It’s really hard for us to focus and to concentrate and the human ability to focus in the concrete for an extended period of time is somewhat of like, the foundation on which prayer is built. It’s going to be really hard to hear God, to come to God, if you can’t pay attention at all. And so I think there’s a part of praying the rosary, which is like physical therapy for the soul. The content works the concentration muscle within. It’s really atrophied.”

While his podcast serves to break down each of the Marian mysteries and the structure of this perfect prayer with palatability in mind, offering both seasoned meditators and newcomers alike a chance to understand it in deeper ways, Father Mark-Mary revealed that the devotion of the rosary can actually be a personalized experience — adding to its perfection.

“[Praying the rosary] is not actually a commandment, but you do have to go to Mass on Sunday,” he said, explaining the difference between devotional and liturgical prayer. “And so within the devotional are good, good things. Whether or not it’s a good thing for you, there’s actually some space for you to make that decision within it. There’s much more space for personalization.”

“There’s many, many people in my life who are doing things that are much more beautiful and much more moving than having a podcast hit number one. People just don’t know about it,” he said. “I’m very grateful for the podcast, its popularity, and it’s a source of grace for people and helping them pray. [But] it’s not the hardest thing I do. It’s not the most honorable thing I do. And it’s definitely not the most heroic or sort of moving thing that my brothers and neighbors do.”

NFL player’s wife says she was ‘heckled, touched and called names’ during game

Whitney Risner, the wife of Minnesota Vikings offensive lineman Dalton Risner, spoke out about the behavior of Detroit Lions fans at Ford Field ahead of their Sunday night matchup.

Risner was doing a “get ready with me” video showing off her outfit before going to the pivotal NFC North matchup between the two teams. She said when the two teams played last year in Detroit, she did not realize how much heckling there was going to be.

“Last year, I wore a flashy purple jacket, and I’ve never been heckled so much at an away game,” she said in the video.

Taylor Saunders, the girlfriend of Vikings linebacker Blake Cashman, also claimed fans were “wishing injuries on the opposing players” in response to a social media comment praising Lions fans.

Former state GOP official kicked out of Republican Party for disloyalty

The Georgia Republican Party’s State Executive Committee has voted to expel former GOP Lt. Gov. Geoff Duncan from being associated with the party, pointing to his alleged efforts to undermine Republican candidates.

The decision, approved unanimously, was finalized on Jan. 6, cutting Duncan’s ties to the GOP after years of accusations of disloyalty.

The resolution makes several allegations against Duncan, including accusations that he undermined GOP candidates, endorsed Democrat opponents and used his affiliation with the Republican Party for personal gain.

In a post on X, Duncan suggested that the resolution was not a good use of the party’s time.

According to the resolution, Duncan is “banned from all property owned or leased by the Georgia Republican Party and all events held by or under the authority of the Georgia Republican Party.”

The Georgia GOP said Duncan is prohibited from qualifying as a candidate for the Georgia Republican Party. The group also said his previous GOP nominations for lieutenant governor and, before that, the state House of Representatives, both races in which he won the primary and general elections, have been expunged.

The resolution demanded Duncan cease calling himself a Republican for personal profit or to undermine and sabotage the Republican Party and its candidates.

The state party also urged media outlets to refer to Duncan as an “expelled Republican” in future references.

The resolution claims Duncan undermined and sabotaged some Republican candidates, including current Lt. Gov. Burt Jones and failed 2022 Senate candidate Herschel Walker. 

It also notes Duncan’s public endorsements during the 2024 presidential race of President Biden and, when Biden dropped out, his subsequent endorsement of Vice President Kamala Harris as a violation of his allegiance to the GOP.

Georgia Republican Party chair Josh McKoon previously demanded that Duncan stop using his Republican credentials in public and media appearances.

The resolution also claims Duncan engaged in a “pattern of false and exaggerated claims” about his education and career.

The Georgia GOP additionally said Duncan, in his role as a CNN commentator, used his Republican title to “attack the Republican Party.”

A new respiratory virus is sweeping the world — and there’s no cure

The Centers for Disease Control and Prevention is closely monitoring reports of a spike in human metapneumovirus (HMPV) in China.

HMPV, which was discovered in 2001, is common but underdiagnosed due to its similarities to the common cold, according to the CDC.

Cases of the virus in the United States are at “pre-pandemic” levels and are not “a cause for concern” at the moment, but there is a large spike in northern China, especially in children 14 and under, according to media reports in Beijing.

Chinese government officials said the reported spike coincides with seasonal illness and seems to be less severe than in other years.

“Respiratory infections tend to peak during the winter season,” the Chinese Foreign Ministry said in a statement on Friday.

Dr. Eileen Schneider, a medical epidemiologist in the CDC’s Division of Viral Diseases, said HMPV is “associated with approximately 20,000 hospitalizations among children younger than 5 years.”

The virus can also be a cause for concern in “older adults and immunocompromised patients.”

Schneider said HMPV presentation is usually mild and can include respiratory symptoms such as cough, fever and nasal congestion.

“The symptoms are often clinically indistinguishable from infection with other common respiratory viruses, such as flu and respiratory syncytial virus,” she said.

There is no vaccine or cure for the virus at this time, the CDC said.

But the infection typically does improve with resting, drinking fluids and over-the-counter medication.

Democratic strategist David Axelrod told CNN that he’s open to President-elect Donald Trump’s success during his second term, telling CNN anchor Anderson Cooper on Monday night that he’d be pleased if Trump was able to get much of his agenda done.

“Donald Trump has said he’s going to lower people’s prices very quickly. He said he’s going to take care of the border, he’s going to reduce crime, he’s going to end war, he’s going to do a lot of things. If he does all those things, God bless him. Good for him and good for the country.” 

While making his point, the former Obama adviser criticized the late conservative radio host, Rush Limbaugh, for wishing former President Barack Obama would fail in office.

“I was, you know, appalled in 2009 when Barack Obama took office, and that very day Rush Limbaugh told the nation he was rooting for Obama to fail,” Axelrod said, suggesting he was not going to be rooting for Trump’s political demise. 

The prominent Democratic figure suggested he’d be supportive of the incoming president, especially if he looks for common ground with Democratic lawmakers. However, Axelrod said he’s concerned Trump won’t put down his grievances with the opposing party in government to allow for that cooperation.

“And if there are places where Democrats and Republicans can cooperate, that is positive,” he said, adding, “The fact is, he has not evidenced in the past a particular desire to want to work with Democrats. If you read his social media feeds, that’s pretty clear – even to this day.”

“It would behoove him, just as it does Democrats, to say, ‘I’ve got have bigger things to do than air my grievances and go after my enemies. I want to work with people where I can.’ And let’s see if he does that.”

Axelrod continued, offering some advice to Trump and Democrats. 

Other prominent Democratic figures have urged cooperation between both parties for the second Trump term, with some going so far as to say that the continuing resistance that the party put up to Trump’s first-term agenda would be a “mistake.”

In a New York Times essay published on New Year’s Day, Rep. Tom Suozzi, D-N.Y., made that point, writing, “As a Democratic member of Congress, I know my party will be tempted to hold fast against Mr. Trump at every turn: uniting against his bills, blocking his nominees and grinding the machinery of the House and the Senate to a halt. That would be a mistake.”

Like Axelrod, Suozzi expressed doubt Trump would cooperate with those across the aisle, but noted that if Trump looks to negotiate with Democratic lawmakers, they should “should meet him halfway rather than be the Party of No.”

There are several ways members of the public can participate in former President Carter’s funeral events on Tuesday, according to the Carter Center. 

Since Saturday, visitors could pay their respects to the late president as he was lying in repose at the Carter Presidential Center in Georgia. The Carter Center provided a schedule of events of the memorial services, as well as a live stream on their website so that members of the public can follow along with the funeral.

The repose for Carter concluded at the Jimmy Carter Presidential Library in Atlanta, Georgia in Tuesday morning, and a departure ceremony is set to be held as he is transported to the airport. Members of the public can watch the family motorcade processions in both Georgia and Washington D.C. 

The former president will be transported from Georgia to D.C. on Tuesday afternoon. Members of the public can watch the motorcade as it travels to the Capitol building in D.C. The Lying in State at the U.S. Capitol will also be open to the public.

The Carter Center on Monday thanked “Georgia and beyond” for the tributes to former President Jimmy Carter, as the former president lay in repose in his home state.

“Thank you, Georgia and beyond,” the Carter Center said on X, posting images of mourners before Carter’s casket.

The former president will be transported to Washington D.C. in the afternoon for another phase of memorials on Capitol Hill. A departure ceremony will be held at the Jimmy Carter Presidential Library, before he is transported to the airport.

Memorial services for former President Jimmy Carter will be held throughout the day on Tuesday.

The repose for Carter, who recently passed away at the age of 100 years old, concluded at the Jimmy Carter Presidential Library in Atlanta, Georgia on Tuesday morning. 

The former president will be transported to Washington D.C. in the afternoon for another phase of memorials on Capitol Hill. A departure ceremony will be held at the Jimmy Carter Presidential Library, before he is transported to the airport. 

There will be an arrival ceremony when Carter arrives in D.C., before the late former president is then transported to the U.S. Capitol for another memorial.

Vice President Harris will deliver a eulogy at the Lying in State Ceremony, where she and Second Gentleman Doug Emhoff will present a wreath on behalf of the Executive Branch. 

There will be a service inside the Captiol building, before the Lying in State is opened to the public.

US ambassador to China pays tribute to former President Carter

The U.S. ambassador to China has paid tribute to former President Jimmy Carter, who played a key role in normalizing relations between the two countries.

Ambassador Nicholas Burns posted a picture to X of the U.S. flag at the embassy in Beijing at half mast.

“Our flag at half mast in the heart of Beijing in honor of President Jimmy Carter. Rest in Peace. ⁦@CarterCenter” he posted.

Carter led the push to normalize relations with the communist country in 1979, even as the Cold War continued. Relations had been severed after the establishment of the People’s Republic of China in 1949.

Former President Jimmy Carter’s grandson paid tribute to his “remarkable” grandfather, who he said put his faith into action, ahead of Carter’s state funeral later this week.

Jason Carter said that the former president, who died last week, was a “remarkable person” and described his life as a uniquely American story.

“And then what he did do after that if he went back home to that same little town and I think their legacy really is a legacy of putting their faith into action and never forgetting who they were, and the remarkable things that come from that.”

Nearly 23K mourners paid respects to Jimmy Carter in Atlanta as repose closes

Nearly 23k individuals visited and paid respects to former President Jimmy Carter as he was laying in repose in Georgia, according to the Carter Center.

Carter, the 39th president of America, passed away on December 29, 2024 at 100 years of age. He has been lying in repose in his hometown of Plains, Georgia since Saturday as part of the first phase of his memorial services this week.

“Thank you to the 22,950 visitors who paid their respects to President Carter in Atlanta,” the Carter center wrote in a post on X, alongside an image of the late president’s casket. “Repose closed this morning, but the online condolence book is still open.”

Carter’s body will be transferred to Washington D.C. for memorial services at the U.S. Capitol and National Cathedral. Following memorials in the nation’s capitol, the Carter family will travel back to the former president’s home state of Georgia for a private service.

Carter will be buried next to his late wife, Rosalynn Carter, by a willow tree on the property of their family home in Georgia.

Mourners pay respects to former President Jimmy Carter

Mourners paid their respects to former President Jimmy Carter on Monday as he lay in repose at the Carter Center in Atlanta, ahead of his state funeral later this week.

Carter died on Dec. 29 at the age of 100, making him the longest-living U.S. President in history.

HIs casket has been lying in repose at the Jimmy Carter Presidential Library and Museum, and will move to the Capitol Rotunda on Tuesday afternoon.

Speaker Mike Johnson, R-La., and other congressional leaders announced last month that Carter would lie in state, writing a letter to his son, James Carter III. 

“In recognition of President Carter’s long and distinguished service to the nation, it is our intention to ask the United States House of Representatives and the United States Senate to permit his remains lie in state in the Rotunda of the United States Capitol,” the leaders wrote.

Members of the public will be able to view Carter’s casket from early Wednesday through early morning Thursday.

Carter’s state funeral service will be held at the Washington National Cathedral on Thursday morning. The former president will then end his final journey with a private funeral service in Plains, before being interred in a private ceremony at the Carter family residence.

Former reporter recalls having access to a ‘very friendly and casual’ Carter during his term

Steven Weisman, the Peterson Institute senior editorial adviser, joined ‘MediaBuzz’ to discuss the life and legacy of the 39th president following his passing.

Weisman, a reporter during Carter’s presidency, recalled working closely with the former president over the years.

“It was a different time. It was much more casual. There was no fancy white house press room,” he said, adding that he was able to speak with the then-president a couple times on the phone.

Weisman was once invited to watch a movie with Carter, where they “talked about movies, we talked about substance…The access was sometimes a little harrowing.”

“It was a little unusual” to be invited, he added. “We watched Coal Miners Daughter. It was a lot of fun to do that.”

Weisman described Carter as a “micromanage,” but that “he eventually changed.”

“In person, he could be very friendly and casual,” he said, recalling a barbeque on the White House south lawn. “It’s quite interesting. He was friendly, he was affable, he said hello to everybody, and then I watched him turn to his wife and say ‘lets go to dinner.’ He didn’t want to have dinner with members,” of congress.

Weisman said that he was you could see that Carter was “a man of faith.”

DC snow storm delays President Carter services at US Capitol

Snowy weather has delayed the transfer of President Jimmy Carter’s body from Atlanta to Washington, D.C. on Tuesday.

Carter is set to lie in state at the U.S. Capitol beginning Tuesday and running through Thursday morning, but the weather has caused a 90-minute delay for all of Tuesday’s events.

Carter and his family had been scheduled to land at Joint Base Andrews outside D.C. at 12:45 ET, before transferring to a horse and buggy in D.C. for a funeral procession to the Capitol building at 2 p.m. ET.

That procession is now scheduled for 3:30 p.m. Members of Congress will be able to pay their respects at a formal service beginning at 4:30 p.m., after which members of the public will be able to visit Carter in the rotunda.

Vice President Kamala Harris, House Speaker Mike Johnson and Senate Leader John Thune are scheduled to deliver brief eulogies for Carter at the afternoon ceremony.

Repose of former President Carter at the Jimmy Carter Presidential Library in Atlanta has concluded

President Jimmy Carter’s time of repose at the Jimmy Carter Presidential Library in Atlanta ended Tuesday morning, and he will now be transported to lie in state at the U.S. Capitol.

Carter had been in repose in Atlanta since a service on Saturday following the former president’s death on Dec. 29.

Carter and his family are now being flown to Joint Base Andrews outside of Washington, D.C., after which a funeral procession will enter the U.S. Capitol and deposit Carter in the rotunda for lawmakers to pay their respects.

Carter will lie in state with the public able to visit until Thursday morning, before a funeral service at the Washington National Cathedral and carter’s final return to Georgia for internment.

funeral services will run a total of six days, having begun in his home state of Georgia before funeral ceremonies in Washington, D.C. before interment at his final resting place in Plains, Georgia.

Carter died on Dec. 29 at the age of 100, with funeral proceedings beginning on Saturday morning in Georgia when a motorcade traveled through Carter’s hometown of Plains.

Carter laid in repose at his presidential center in Atlanta from 7 p.m. Saturday to 6 a.m. Tuesday. The public was able to pay their respects to the former president during those days at all hours. 

Carter’s funeral procession moves north on Tuesday. He will lie in state in the Capitol Rotunda in Washington, D.C., until his state funeral on Thursday at the National Cathedral. Members of the public are invited to pay their respects to Carter in Washington, D.C., on Wednesday. 

All living former presidents have been invited to Carter’s funeral on Thursday at 10 a.m. President Biden is expected to eulogize Carter during the funeral.
