Federal judge rules in Trump deportation clash with anti-Israel ringleader

A federal judge sided with Mahmoud Khalil, an anti-Israel ringleader detained by the Trump administration, blocking the government from continuing to hold him on “foreign policy” grounds.

U.S. District Judge Michael Farbiarz on Wednesday granted a preliminary injunction preventing the government from detaining or removing Khalil, 30, based on a memorandum issued by Secretary of State Marco Rubio. The memo asserted that Khalil’s presence “compromises a compelling foreign policy interest.”

“The government cannot claim an interest in enforcing what appears to be an unconstitutional law,” Farbiarz wrote, adding that the threat to free speech raised serious First Amendment concerns.

The ruling is a significant legal setback for the administration’s efforts to deport Khalil, who has been held at a detention facility in Louisiana following his involvement in anti-Israel demonstrations at Columbia University.

FEDERAL JUDGE SAYS ATTEMPTED DEPORTATION OF ANTI-ISRAEL RINGLEADER MAHMOUD KHALIL MAY BE UNCONSTITUTIONAL

While the ruling grants a preliminary injunction against Khalil’s removal, it stops short of ordering his release.

The court’s decision will remain on hold until Friday morning, giving the government time to appeal.

ANTI-ISRAEL RINGLEADER MAHMOUD KHALIL’S FREE SPEECH LAWSUIT AGAINST US GOVERNMENT MUST BE HEARD: JUDGE

Khalil, a green card holder, was arrested after leading student protests on the Ivy League campus. He has argued that his free speech rights were being “eroded” by the Trump administration.

Department of Homeland Security (DHS) attorneys have argued that Khalil’s free speech claims were a “red herring,” saying that the 30-year-old lied on his visa applications.

Khalil, they said, willfully failed to disclose his employment with the Syrian office in the British Embassy in Beirut when he applied for permanent U.S. residency. The agency also accused Khalil of failing to disclose his work with the United Nations Relief and Works Agency for Palestine Refugees and membership in Columbia University Apartheid Divest.

Rubio has cited a provision in the Immigration and Nationality Act of 1952 to justify Khalil’s removal from the U.S. The provision allows the secretary of state to deport noncitizens if the secretary determines their presence in the U.S. “would have serious adverse foreign policy consequences.”

Rubio accused Khalil of participating in “antisemitic protests and disruptive activities, which foster a hostile environment for Jewish students in the United States.”

“Condoning antisemitic conduct and disruptive protests in the United States would severely undermine that significant foreign policy objective,” Rubio wrote.

Khalil has Algerian citizenship through his mother, but was born in a Palestinian refugee camp in Syria.

As of Wednesday evening, no further hearings are scheduled in Khalil’s immigration case

“We’re just waiting for the judge to issue her ruling,” Johnny Sinodis, a partner at Van Der Hout LLP who is representing Mahmoud Khalil in immigration proceedings, said during a press conference following the hearing.

Meanwhile, the federal court’s preliminary injunction will prevent Khalil’s removal until at least Friday.

LA prosecutor warns violent protesters after felony charges are filed

NEWYou can now listen to Fox News articles!

Los Angeles County District Attorney Nathan Hochman sent a strong warning Wednesday to those behind the recent riot violence: “We will track you down. We will arrest you. We will prosecute you. And we will punish you.”

Standing with LA Sheriff Robert Luna and LAPD Chief Jim McDonnell, Hochman announced felony charges against several rioters accused of attacking officers, looting stores and vandalizing public property.

More arrests and charges are expected in the coming days.

“Let me provide some bad news for you,” Hochman said. “There’s a tremendous amount of video out there through social media, and otherwise we will know who you are, who engaged in this conduct. … So, for people who’ve already engaged in this, in this illegal activity, we’re coming for you.”

ICE RAMPS UP ARRESTS OF CONVICTED CRIMINALS AS RIOTS RAGE IN BLUE CITY: ‘YOU WILL NOT STOP US’

Five criminal cases were detailed during the press conference. Juan Rodriguez of Gardena is accused of handing out and throwing commercial-grade fireworks at LAPD officers, injuring one. He faces over six years in prison.

Randy Paul Ruiz and Georgina Rava-Yero allegedly drove motorcycles into a police line, injuring officers. Both face felony charges and over six years in prison.

In a separate case, Timmy Paulk and Rayven Mitchell were charged with allegedly looting a Nike store downtown. They face up to three years in prison.

SENATOR LAUNCHES INVESTIGATION INTO DEMOCRATIC ORG OVER POTENTIAL SUPPORT FOR LA RIOTERS

Ulysses Sanchez, a three-strike felon, was charged with assault and gun possession after allegedly recklessly driving through downtown and injuring bystanders. He could face 25 years to life.

Christopher Gonzalez and Yoselin Johnson were charged with felony vandalism after allegedly painting graffiti on the Hall of Justice. Deputies say they found paint buckets and a large roller pole in their car.

“These are not protesters,” said Sheriff Luna. “There’s a big distinction between individuals that protest and demonstrate to violent, destructive, basically anarchist. … What we’re talking about are the individuals who don’t care about the issue at hand.”

Luna praised the district attorney for taking fast action, assigning a special prosecutor to focus on crimes against law enforcement. He also noted help from federal agencies, with some suspects possibly facing federal charges.

Chief McDonnell revealed some of the dangers officers have faced in recent days. He said officers have been targeted with fireworks, Molotov cocktails and even mortars.

“This is no longer a protest when commercial-grade fireworks are being used as weapons, and our officers are under direct attack,” he said. “That’s not free speech. That’s a felony.

“If you assault the peace officer in this city or this county, you will be held accountable.”

“We will facilitate all peaceful First Amendment activity,” said Sheriff Luna. “But when you have people that are out here to commit acts of violence, against our deputy sheriffs or police officers or, just, they’re destroying our city. We’re going to stop it.”

Trace Cyrus blasts Billy Ray as ‘hungry for fame’ after refusing to attend funeral

NEWYou can now listen to Fox News articles!

The Cyrus family household drama continues to unfold.

On Tuesday, Trace Cyrus – who was adopted by Billy Ray Cyrus shortly after his marriage to ex-wife Tish Cyrus in the ’90s – aired his own grievances with his dad on social media.

“This man is so hungry for fame, it’s pathetic,” he wrote on Instagram. “He really flew to Italy for a fashion show but wouldn’t come to LA for Mammie’s funeral while he was still married to my mom. Even after his daughter got him a 60k private jet like he demanded then he still didn’t come after the plane was paid for.

“You’re the lamest man to ever walk planet earth. Honestly embarrassed to have ever considered you my idol. The best thing to come from your downfall is it made me go into beast mode. I refuse to be a washed up, delusional, evil person when I’m old like you. Christ is King. Get right with God. You need it.”

BILLY RAY CYRUS’ INAUGURATION STUMBLE REIGNITES YEARS OF HOUSEHOLD DRAMA: WHO’S WHO IN THE FAMOUS FAMILY

A representative for Billy Ray did not immediately respond to Fox News Digital’s request for comment.

That same day, during an appearance on the “Reclaiming with Monica Lewinsky” podcast, Miley Cyrus, 32, got candid about her “messy” family drama and explained how she’s been able to heal ongoing feuds between her and certain members of her family – including Billy Ray.

“My family and I have had a really difficult… What did you call your decade? Dark decade. Yeah, we had one of those,” Miley said.

“Half of us weren’t speaking to each other at one point, and we cleaned all that up,” said the singer, whose siblings include Brandi, 38, Trace, 36, Christopher, 33, Braison, 31, and Noah, 25. “That was a really important part of my year this year, was all of my family putting those lines of communication back together. A lot because of, you know, I had a lot of loyalty to my mom [Tish Cyrus], the way that families do when parents get divorced.”

“In that situation, I watched what happens when you don’t clean things up as they’re happening. They really do stack, and then all of a sudden you go, ‘Oh my God, it’s been 10 years, and this is a mess that I barely even know how to start. This is like emotional hoarding.’”

Billy Ray married Tish in 1992, and they divorced in 2022. After the divorce, relationships between multiple members of the Cyrus family were negatively impacted.

As far as Miley’s relationship with her father, she said it was easier for her to surrender instead of seeking family therapy.

“We’re so messy we didn’t even do [therapy],” she told Lewinsky. “To get each other in a room to even get to counseling would have been a war. So it was easier to just go, ‘White flag.’ I always wanted my family to feel like I was the safe place, that I always had the white flag when they came to talk to me.”

“But I just kind of bust through the pile that’s stacked, and just go, ‘I’m here. You’re here. Let’s start by having a good time together.’ And then as we start bringing some happiness and joy into each other’s life, then we’ll just be in a better place to have these conversations. ‘Cause I’d rather get it balanced first,” she added.

Earlier this month, Miley spoke candidly about mending her relationships with both Billy Ray and Tish.

“I think timing is everything,” she began. “As I’ve gotten older, I’m respecting my parents as individuals instead of as parents – because my mom’s really loved my dad for her whole life, and I think being married to someone in the music industry and not being a part of it is obviously really hard. And so I think I took on some of my mom’s hurt as my own because it hurt her more than it hurt me as an adult, and so I owned a lot of her pain.”

She continued, “But now that my mom is so in love with my stepdad, who I completely adore, and now that my dad, I see him finding happiness, too – I can love them both as individuals instead of as a parental pairing. I’m being an adult about it.”

Miley said it was “hard” at first, “because the little kid in you reacts before the adult in you can go, ‘Yes, that’s your dad, but that’s just another person that deserves to be in his bliss and to be happy.’”

Democrats give their congressional lawmakers a big thumbs-down in new national poll

NEWYou can now listen to Fox News articles!

Most Democrats disapprove of how their party’s lawmakers in Congress are handling their jobs, according to a new national poll.

Fifty-three percent of Democrats questioned in a Quinnipiac University survey released Wednesday gave their party’s congressional members a thumbs-down, while 41% approved of their performance.

According to the poll, conducted June 5-8, just 21% of all voters approved of the way Democrats in Congress were handing their jobs, with seven in ten disapproving.

The 21% approval is the same as in Quinnipiac’s February national poll, matching “an all-time low since Quinnipiac University first asked this question of registered voters in March 2009.”

The survey indicates 79% of GOP voters approve of the way congressional Republicans are handling their job, with 13% disapproving.

WHERE TRUMP STANDS IN FOX NEWS POLLING 100 DAYS INTO HIS SECOND TERM

Among all voters, 32% approved of how GOP congressional members were performing their duties, while just over six in ten disapproved.

Overall approval for Republicans in Congress has dropped eight points since Quinnipiac’s February poll, with disapproval jumping nine points.

The Democratic Party has been in the political wilderness since November’s elections, when Republicans won back control of the White House and the Senate and defended their fragile House majority. And Republicans made gains among Black, Hispanic and younger voters, all traditional members of the Democratic Party’s base.

Since President Donald Trump’s return to power earlier this year, an increasingly energized base of Democrats is urging party leaders to take a stronger stand in pushing back against the president’s sweeping and controversial agenda during the opening months of his second administration. And their anger is directed not only at Republicans, but at Democrats they feel aren’t vocal enough in their opposition to Trump.

And that’s fueled a plunge in the Democratic Party’s favorable ratings, which have hit historic lows in several surveys the past couple of months.

The new poll from Quinnipiac also indicates a decline in Trump’s approval ratings among voters nationwide.

Thirty-eight percent of those questioned in the survey said they approve of the way the president is handling his duties, down three points from Quinnipiac’s early April poll.

Fifty-four percent in the new poll gave Trump a thumbs-down for his handling of his job as president, down one point from the April survey.

Trump’s approval ratings were mostly above water as he returned to the White House in late January, but his numbers soon slid underwater in many national surveys and remain in negative territory nearly five months into his second administration.

Woke writer attacks Riley Gaines as ‘uncivilized’ — and the backlash was furious

Dan Wolken — proudly a far-left sportswriter, cut from the same cloth as Keith Olbermann — is crying over OutKick’s own Riley Gaines.

Wolken stumbled into the Gaines-Simone Biles discourse after the two women seemingly buried the hatchet over an online spat where Biles threw unprovoked personal jabs at Riley.

Gaines has been branded “evil” by leftists and leftists in sports media for her stance on keeping trans athletes out of women’s sports.

It’s one of those 90-10 issues where Dan Wolken, somewhat ignorantly, thinks he’s in the majority (he is not).

Wolken jumped onto his soapbox Wednesday after Gaines’ Fox News appearance discussing the spat. On X, he labeled Gaines “uncivilized” for addressing Biles’ public apology.

“If you apologize and try to be civil with bad people who have no intention of being civil, you will get burned,” Wolken whined, targeting Gaines over an apology Simone issued.

Social media users had their own thoughts on Wolken’s jab at Riley.

“You are an ass… she’s not a bad person but you are for calling her one.. grow up,” one person responded.

Another reaction added, “Why do you want males playing in female sports? In what world is that even remotely fair?”

Biles, an Olympic gold medalist with a pro-trans view on women’s sports, issued her apology, though many saw it as hollow and forced.

Biles wrote, “The current system doesn’t adequately balance these important principles, which often leads to frustration and heated exchanges, and it didn’t help for me to get personal with Riley, which I apologize for.”

While Gaines accepted it, she noted Biles’ ardent support for men in women’s sports, which creates impact beyond social media, harming women’s ability to compete in the real world.

And as we all know: Liberals despise women like Gaines who boldly stand up for fairness in women’s sports.

Against Biles, Gaines stood firm, advocating for fair competition by keeping men out of the competition.

Wolken has supported keeping men in competition, largely posturing to the industry he serves.

Gaines’ platform has long been a target for Wolken, who champions trans athletes.

Wolken vocally supported trans athlete Blaire Fleming at San Jose State University, despite women being injured by Fleming’s superior strength on the volleyball court.

Teammates like Blaire Slusser objected but feared backlash from the likes of Wolken, who shamed them into silence.

“San Jose State is 6-6 in Mountain West games that were actually played this season. If you had any doubt about the sincerity of this grift,” Wolken snickered.

OutKick founder Clay Travis fired back at Wolken’s unhinged take:

“So your argument @danwolken is that men who compete in women’s sports are only an issue if the men are on good women’s teams? Left-wing sportswriters have lost their minds and are competing to see who can be the craziest.”

Other liberal journalists reeling from Gaines’ victory over Biles include Jemele Hill, Nancy Armour and Katie Nolan.

As OutKick’s Ian Miller previously noted, Wolken’s never been known for being smart.

To him, accepting basic biological truths deserves scorn, which explains his obsession with vilifying Gaines. Is there anything evil or uncivilized about keeping women’s sports fair?

Only someone as obtuse as Wolken would think so. Someone grab him a Speedo and swim cap if he truly wants to take on Gaines … we all know he’d love that.

Steelers’ Aaron Rodgers frustrated after being forced to abandon trusty equipment piece

Aaron Rodgers is excited to start his new journey with the Pittsburgh Steelers, but he already has one complaint.

He hates his helmet.

“I can’t stand the helmet,” the quarterback told reporters on Tuesday, as he’s no longer allowed to wear the Schutt model he has usually sported throughout his career. “I’ve worn a Schutt for 20 years and somehow it finally didn’t pass the safety standard.”

Rodgers sported a Schutt Air XP Pro Q11 LTD during his games last season with the New York Jets, which is rare when it comes to helmets in the NFL. Only Joe Flacco, Thomas Morstead and Nick Folk wore the same model.

Rodgers is no stranger to changing his helmet, as he seemed to be fine with it in 2019 when he was forced to find a different model. But the second time around, he’s finding it an issue.

AARON RODGERS REVEALS HE HAS BEEN MARRIED FOR ‘A COUPLE MONTHS’

Now, Rodgers has time once more to find a new helmet being that it is only mandatory minicamp right now.

But, whether Rodgers likes it or not, the NFL’s top priority is safety. As new helmet technology gets developed, older models of helmets will become obsolete.

Rodgers has only been with the Steelers for a few days, but he’s already made a few headlines at minicamp.

The biggest of them all was him revealing his wedding ring to reporters on Tuesday, claiming he had been with his partner for “a couple months.”

Speculation about Rodgers being married has been swirling since photos from the Steelers announcing his signing went viral. He was wearing the same band on his left hand.

The woman Rodgers married remains a mystery, but he did claim on the “Pat McAfee Show” in December that he was dating a woman named “Brittani.”

Rodgers signed a one-year deal with the Steelers reportedly worth up to $19.5 million with incentives.

The four-time MVP has a $10 million guarantee in his deal, per ESPN. The announcement by the Steelers ended a long offseason journey that had many believing Rodgers would end up in Pittsburgh as quarterback-needy teams found options elsewhere.

When the Steelers waited until the sixth round to take a quarterback (Will Howard), all signs pointed to Rodgers joining head coach Mike Tomlin’s group.

Now that he is with the team at minicamp, Rodgers will try to get acclimated with his new weapons, including wide receiver DK Metcalf, who was traded by the Seattle Seahawks this offseason.

But he will also need to figure out what new model of helmet he can be comfortable in this season.

Griffin warns ‘The View’ co-hosts against smearing ICE agents following Trump orders

NEWYou can now listen to Fox News articles!

“The View” co-host Alyssa Farah Griffin on Wednesday warned her co-hosts against “demonizing” Immigration and Customs Enforcement (ICE) in their discussion about the Los Angeles riots.

“I think Trump is not doing this just for optics,” co-host Sunny Hostin said. “I think that this is a test case so that he can dismantle some of our institutions. I think it’s a power grab. I think he is trying to use the might of the military to suppress people’s rights. I think that is very clear. When you use the military against your own citizens, that is a sign of fascism. That is just the truth.”

The co-hosts continued to criticize the president for his decision to send in troops to aid law enforcement.

Griffin then urged the co-hosts to be careful not to “take the bait,” as Hostin insisted that she didn’t think it was bait.

NEWSOM SAYS LOS ANGELES RIOTERS WILL BE PROSECUTED, SLAMS TRUMP FOR ‘TRAUMATIZING OUR COMMUNITIES’

“I haven’t made my point yet,” Griffin said. “The ICE agents, those are nonpartisan actors, for the most part, who signed up for jobs and served under multiple administrations. They did not necessarily sign up to be doing this, and they’re following an order of the commander-in-chief.”

Co-host Whoopi Goldberg and Hostin said they weren’t demonizing them.

“We’re saying this is the result of ICE, ICE’s actions,” Hostin insisted. The liberal co-host blamed ICE for the crisis in LA on Tuesday.

Griffin added, “I think it’s important to remember it’s the commander-in-chief that made the decision. They’re following the orders.”

Goldberg then made a seeming comparison to Germany in the 1930s, saying, “Where have you heard that before? ‘I’m just following orders from the commander-in-chief.'”

Goldberg agreed with co-host Sara Haines, who said she didn’t blame the National Guard or the Marines, but said they needed to be careful.

“I think it’s important we remember statistically the National Guard, the Marines and even these ICE agents… half of them probably have your political views. Half of them are probably pretty uncomfortable with these orders. They have families at home. They have bills to pay, and they’re questioning should I walk away from this,” Griffin pushed back.

Goldberg agreed and then went on to say construction companies and more would have a harder time getting people to work without immigrants.

Hostin insisted on Monday that being undocumented was not illegal during a conversation about the riots in LA.

The Transportation Security Administration (TSA) has issued a reminder to flyers about the foods they can and cannot bring on board planes.

TSA posted a “breakfast travel tip” on Monday on its X account, noting, “We don’t suggest leaving this delicious pastry behind.”

The post featured a photo of “The Simpsons” character Homer eating a donut pasted into the corner of a security checkline.

PASSENGER DEFENDS CONTROVERSIAL ‘GATE LICE’ BEHAVIOR AS AIRLINES CRACK DOWN ON EARLY BOARDING ATTEMPTS

“Donuts are g2g[good to go] in carry-on or checked bags, no matter what toppings you choose,” the post said.

“How many you decide to bring is up to you.”

TSA then added a link sharing guidance for traveling with certain food items.

Sixty different food items are listed in terms of the items travelers may pack in their carry-on bag or checked luggage, with some restrictions on particular items.

Travelers may pack pies, cake, pizza, solid cheese and chocolate, cooked meat, cookies, crackers, candies and cereal.

“Solid food items (not liquids or gels) can be transported in either your carry-on or checked bags,” reads the TSA website.

TSA advises that travelers should separate such items “that can clutter bags and obstruct clear images on the X-ray machine.”

Even live lobsters can be packed — as long as they’re in a clear, plastic and spill-proof container.

A TSA officer will visually inspect your lobster at the checkpoint,” reads the restriction. “We recommend that you contact your airline to determine your airline’s policy on traveling with your lobster before arriving at the airport.”

Tamales are allowed with no restrictions listed.

Coffee, creamy cheese, canned foods, gravy, ice cream and hummus are allowed to be carried on if the items weigh less than 3.4 ounces.

While fresh fruits and vegetables are allowed, there are special instructions related to them.

“Passengers flying from Hawaii, Puerto Rico, or the U.S. Virgin Islands to the U.S. mainland cannot take most fresh fruits and vegetables due to the risk of spreading invasive plant pests,” the TSA says.

Trump reveals stance on Musk feud after billionaire’s stunning criticism

NEWYou can now listen to Fox News articles!

President Donald Trump says in a new podcast interview that he is open to reconciling with Elon Musk over their falling out due to Trump’s “big, beautiful bill.”

“Look, I have no hard feelings,” Trump said during an interview on “Pod Force One with Miranda Devine” that was published Wednesday. “I was really surprised that that happened. He went after a bill that’s phenomenal. He just — I think he feels very badly that he said that, actually.”

Musk, founder and CEO of SpaceX and Tesla, Inc., who headed up Trump’s Department of Government Efficiency (DOGE) and was assigned to trim $2 trillion from the federal government’s budget, announced he was leaving DOGE in a post on X on May 28.

CALL WITH CHINA’S XI, AND TRUMP, MUSK EXCHANGE FUELED BARBS DURING 20TH WEEK IN OFFICE

The relationship between the two began souring after Musk called out Trump’s bill in a June 3 post on X, saying, “I’m sorry, but I just can’t stand it anymore. This massive, outrageous, pork-filled Congressional spending bill is a disgusting abomination. Shame on those who voted for it: you know you did wrong. You know it.”

The two then traded fierce social media barbs, with Musk even saying Trump was in the so-called Jeffrey “Epstein files.” The bill has been projected by the Congressional Budget Office to add trillions to the country’s already rising $36.2 trillion national debt.

Trump’s spending bill, meant to extend his 2017 Tax Cuts and Jobs Act as well as provide new funding for the border and defense, passed the House on May 22 and is currently in the Senate.

Trump said that he was “disappointed” in Musk, but said things like this happen, and that he is open to mending fences.

“I guess I could, but we have to straighten out the country,” Trump said when Devine asked if he and Musk could become allies again. “And my sole function now is getting this country back to a level higher than it’s ever been. And I think we can do that.”

Trump made the comments on the inaugural episode of Devine’s “Pod Force One.”

Every week, the award-winning New York Post columnist will sit down for exclusive and candid conversations with the most influential disruptors in Washington.

Devine, who was the first to report on Hunter Biden’s scandalous laptop in 2020, will speak with top newsmakers and lawmakers, going beyond talking points to discussions aimed at shaping America’s future.

“On Pod Force One, I’ll be speaking to the most powerful people in the world, finding out what really drives them — their motivations, beliefs, and desires,” Devine said when announcing the project.

“Pod Force One” is available on NYPost.com, Spotify, Apple and everywhere you get your podcasts.

“We couldn’t have a better host than Miranda Devine. She’s a legend, and she’s bringing today’s biggest newsmakers to the mic. Get ready — we’re going to break some news,” Post Editor-in-Chief Keith Poole said.

Musk has appeared to soften his tone in recent days, saying in an X post on Wednesday, “I regret some of my posts about President @realDonaldTrump last week. They went too far.”

“I haven’t thought too much about him in the last little while, but the bill is so good,” Trump told Devine. “This bill is going to turn around this country so fast your head will spin, and it’s good for everyone.”

Later on Wednesday, Trump told the Post it was “very nice” that Musk had issued a mea culpa.

Devine told Fox News Digital she couldn’t have asked for a better first guest than Trump.

“He was generous with his time and full of fascinating insights about what makes him tick,” she said. “We talked about everything from Elon to Iran, drones over New Jersey to the secret of Joe Biden’s autopen. He even shared his tips for success in life and good parenting.”
